Taking the Circuit opinion at its word, there's a lot of room to simply tweak the order, but that doesn't stop Washington State from simply starting the circus all over again once the order is changed. I'd probably make the revisions and go one more round through the Ninth Circuit. They'll stick it to him again anyway, but it buys a bit more time to put Gorsuch on the SC to pad their margin. I wouldn't be surprised if this is the approach they take.
But out of principle, they might just proceed directly to the SC. They should already win based on the Executive's plennary power so they might be inclined to just give the Ninth the finger.
