It would be negotiable for me if it came to that.  Probably better than most places but not awesome.

Cut your hair and when you boss comes by asking where Emo went, keep your eyes down and mumble "don't know".

Your negotiation position can't be too good if you're getting laid off

Tell people you have another big doctor's appointment this afternoon.  Shave off all your hair and eyebrows before work tomorrow.

Also, how's your resume? Did you sniff some smoke and have it out there already?

It would be good enough to get a better than average severance.

I honestly have no idea why companies give severance. They don't have to, do they?

ours is based on a formula that uses years of service and position. both equate to higher amounts obviously. I'd currently get like 9 months if I got laid off. I don't know if that's how everyone else does it though. ours is definitely not "negotiable" which I don't really understand.

I think they probably do it so that the employees that don't get laid off can see that there is at least some safety net if they stick around. It's the only reason I can think of, really. The "am I next?" feeling among the employees probably makes some of them apply elsewhere.

If they are laying you off, why would they negotiate?

Like, you are going to say "If you don't give me more severance I will tell all your company secrets to this other company over here." ?

I am no HRcat but maybe paying severance is cheaper than having ex-employees filling for unemployment

That's one reason for sure, like if they ask you to sign a release.  Of course there are other reasons.  Terms of the severance is, at minimum, negotiable.

companies give severance for a lot of reasons, not the least of which is to build good will and protect themselves against lawsuits

employees are still going to file for unemployment after severance runs out

it also usually prevents you from signing up for unemployment during the period covered by the severance.
