The “I will put a black woman on the Supreme Court” is one of the worst campaign pledges of all time because it is so incredibly undermining to the candidate pool and especially the eventual candidate. It makes clear that even if you find someone impeccably qualified that they are, according to your own statement, the best qualified black woman for the job.  It is just an insane self-own. It is such a disservice to the eventual nominee and will make the confirmation hearings so much more awful than if he hadn’t said that.

Only possible ju-Jitsu saving grace is that the Republican senate judiciary lineup is a who’s who of the biggest southern racist crap heads so there is a strong opportunity for one of them to say something so dumb and racist that the nomination gets overshadowed by republicans are racist.  The downside is that the dems won’t bother to wait around for this to happen and will prime the pump so much that the racism engine might not turn over.

I get the point, but I don’t agree with it. Anyone who thinks about the reality of the situation for more than 30 seconds is going to appreciate that there are dozens if not hundreds of candidates who could be called “the most qualified.” Let’s also be cognizant that any super old white guy saying they’re focused on hiring the most qualified candidate can easily be perceived as a dog whistle which I’m sure Biden wanted to avoid.

Do you feel the same way about employers outwardly placing an emphasis on recruiting diverse candidates? Cause that is for sure happening at like every large employer.

No, I think he absolutely should have considered the identity of the candidate as a consideration, but he should not explicitly say that he is starting with a limited pool of candidates to the exclusion of all others on demographic lines. It just immediately undermines the person who gets it, particularly when they have to go under hostile, public, questioning to get the job and will no doubt be asked about a statement they didn’t even make and a process that they did not control.

I think the bullshit dance around whether or not the nominee will uphold or strike down Roe or other major decisions is silly because a president would be insane not to have a very solid idea about how the nominee will rule and the Supreme Court is, despite Spracne’s protestations, fundamentally a political body with elected representatives for each political party placed there to represent their respective ideologies.

But the reason that people bullshit about all that and pretend, is to make it easy for the nominee to breeze through the confirmation and be able to honestly say that they did not disclose how they would rule on decisions to the president, not make any assurances, and that they would carefully consider each issue before them etc.

Biden blew up all pretense. In most cases I would respect it, but in this instance I happen to pity the person that has to wear his eff up for him through no fault of their own.

A bit of a tangent, but the funny thing about nominating someone based on their political leanings is that the collective ideologies of our two main parties change far more rapidly than whatever 50-ish year old gets appointed.

There’s a ton of historical examples but just look how John Roberts is portrayed by conservatives now.

As for Biden saying he’s going to nominate a historically diverse candidate, I have a hard time imagining it would do anything to undermine the nomination process. Republicans are going to whine about something no matter what (just like the Dems did). And I honestly believe that having a diverse background and perspective IS a qualification that warrants emphasis in the process.

I mean, he kind of did the same thing with his VP. Perhaps his team thinks telegraphing your pick is better messaging to voters than just picking someone and saying they were the best person for the job.

If he would have said something like “I want to look to a more diverse pool of candidates on what has been a court that historically has been anything but.” Then it is a non story, it is the ham fisted pledges for VP and the Supreme Court that became the story.  The pledge is in the title of every piece, it is the story.

don't disagree with the present day impact,but i do disagree that it was a self-own.  it was an explicit ask from possibly his most important supporter at a time when he was in very grave danger of losing the nomination.  it was forced upon him, it was not of his own choosing.

I have no problem with him making that promise if he intends to keep the promise. It's absurd that we've not had a black woman sit on the highest court. If someone at some point isn't intentional about correcting this we'll continue to see generations of black women ignored in federal courts.

He's done a great job of appointing black women. He's done a fantastic job of appointing black women as federal judges to this point. One of his federal appointees, Ketanji Brown Jackson, clerked for Breyer.

Ronald Reagan made a campaign promise to put a woman on the supreme court and then followed through with it, so it's not like this is unprecedented. We also shouldn't pretend that the nomination ever actually goes to the most qualified candidate, anyway. Too much emphasis is placed on Roe v Wade to allow for that.
