when a passenger purchases a ticket in good faith and the airline decides that they will not honor that ticket, not due to an act of god, not due to the behavior of the passenger, not due to safety considerations. not due any externality, but solely because they believe it to be more profitable to transport another person in his stead, that is a failure of the free market.
when the free market fails, regulation may be the only solution.
