Former President Donald Trump's attorney on Tuesday argued that a president could order the assassination of his political rival and couldn't be prosecuted for it — unless Congress impeached and convicted that commander in chief first.

Trump's lawyer made the argument in a contentious appeals-court hearing Tuesday in the special counsel Jack Smith's election-interference case against the former president.

Trump's legal team has repeatedly argued that the ex-president has "absolute immunity" from criminal prosecution related to his acts while in office (a claim many legal experts reject).

They are really trying to give the DB the keys to the kingdom, huh?

lmao there's no way Trump's team lets him present his own closing arguments....right?? He'll chicken out as usual but then later claim to his moron supporters that the deep state, Soros-backed judge wouldn't allow him to speak and it's also proof that the trial was rigged against him. There's just no way he'll let an opportunity to cry and whine about being a victim pass like that.

definitely not "allowed" but have seen it occur when they take the stand. But no, they are not allowed to open/close/argue motions.

Maybe it's a relic of N.Y. Sup. Ct., but Engoron, J. wrote (via e-mail) that it was his discretion to decide. I've never encountered it in the wild.

Obviously judges have discretion in how to run their trials. Seems to me it would have been a heck of a lot easier to just say “no” but I think the judge was kinda hoping to get the chance to dress Trump down in front of the jury when he inevitably blows it.
