Here is my understanding.  It is probably wrong, as I really don't read much on this anymore:

WVU and Big East suit ended in Judge saying they both need to take their asses to non-binding arbitration to resolve their issues with WVU leaving.

As I am sure Pete knows, Non-binding arbitration puts both parties in a room with a arbitrator to act as a go between and to help negotiate the issue between the two parties to a common ground resolution.  However, since it is non-binding, they can spend all that time and energy, come up with a common ground resolution, shake hands, then immediately tell everyone to eff off as they leave the room and that they changed their mind, but thanks for the free lunch and drinks.

At that point, it is back to square one = current conference agreement would be the only binding agreement standing.

No.  There is an agreement in place(conf agreement).  They both agreed to it.  No one HAS to budge on that.

I picture them full of indignation, gesturing wildly about bball status and BCS games everyone made fun of at the time, adamantly insisting to everyone that they have options, a national following, and will be a prize for any conference.

Also, the arbitrator hasn't said that.  The judge just ordered it a day or two ago so the arbitration prob hasn't taken place yet.

Again, there may be more to this.  I haven't been keeping very close track.

This is prob a good time for the resident lawyers to kick in, but it is my understanding that it is common for a judge to do all that they can to make two parties of a civil disagreement do all they can to work it out on their own since the judge has no skin in the game yet their judgement is binding legally. 

I would sure think that this will end back up in front of the judge.

I don't think WVU can risk just simply walking away from the Big East this year with the expectation of figuring out how much it will cost after they've already gone.  Meaning, they can't tell the Big East to go eff themselves and release their 2012 Big 12 schedule in Feb, and then meet in front of a judge in Apr and find out that the price tag is far more than they expected/can afford.

WVU has to wait until there is some sort of binding decision that tells them what the price tag is.  The Big East has to delay until the Big 12 can't afford to keep waiting on WVU.  It seems to me that the Big East has the upper hand here, simply because WVU's window of opportunity is so short.

WV has already thrown all their luggage off the titanic and renamed their lifeboat(see bball practice gym). I doubt they are going to sit around and bullshit with the captain about how much they owe for jumping ship when there wont be a ship or anyone to collect a year or two from now.

As soon as WV gets in the lifeboat and pushes away Louisville and Rutgers jump ship as well and start swimming like hell after the life boat. UConn and Cincy will be floating around the open ocean on wooden door trying to knock each other in the ocean to save their own life.

There will literally be no one left to try and collect any money from WV, the Big East is dead.

No Denied.  The cost of us potentially losing our tier II contract with Fox, if we don't have the minimum 10 teams for next year, would be too costly to let this happen.  We will have WVU & TCU this year.  When tier I contract negations start, we will hopefully invite Louisville & Notre Dame.  Big East will mearge with CUSA and will still be Big East or some variation of it.

WVU is gonna be here next yr regardless.  If nothing else, they will pull a Missouri, say eff it, leave, schedule w/ new league, all while penalties are being lawyered out. 

Our conf has too much financial interest in the balance to let it go down any other way.

Schedules would be played, I have no doubt of that.  However, I am assuming that any contract between conference and it's members that limits the amount of warning needed to leave would also state penalties for failing to do so.  So, if no further or additional agreement is made btwn conf and WVU, the existing contract would be enforced.  I don't know what their current contract says about penalties, but I believe it is somewhat light.  I say that because after this WVU to Bi12 thing started the Big East reconvened and voted to change their exit penalties by double.
