I've heard non-competes don't hold up in court very well.

Depends.  Huge stud lawyers can usually get them enforced.

But they are only worth a crap for high earners.

So if herrsonwhatever gets hit by a bus tomorrow his company probably folds huh?

Whole place burns down, is how i'd imagine it.

Also, if you aren't actively being compensated by your former employer any longer, non-competes are essentially unenforceable.   If you're still receiving severance, other compensation they can of course yank that and file suit for breach of contract.  Or if you got a big pay out on separation, they can sue for that back.   But like, if you part ways on even terms, they can't continue to hold a non-compete over you.

Between hiring and training to replace me, every job I've been in has paid me out vacation and usually a bit of a premium to stick around a little longer.  I factor it in when setting the start date for the new job and tell the old job that they are cutting into the time it will take me to move/whatever to a new town so I need some more money.  Hasn't burnt any bridges and has generally worked out well.

I wouldn't sign a non-compete for a sales position.

Sales people in my industry jump around a lot because the big money is in gaining new logos.  If you have a few big clients, you can move to a new company and sell them a new product instead of an upsell or renewal of the product they already have.

I don't think she knew where to go. This new job is a perfect fit for her. She got a lot of experience through hallmark and liked the benefits, etc. She applied at this place like 2 months ago for another position and they followed up with her last week to see if she'd be interested in a senior marketing position. I thought that was pretty impressive that they kept her file.

A lot of companies have a longer hiring cycle than 2 months from application to offer anyway...

That's how she's been feeling, but when they're laying off like rapid fire, that doesn't really leave much room for negotiation.

Hallmark has 100 applicants for every job.  People want to be there.  If you are good at your job there, you will get nice raises consistently.

Do you have a lot of friends there, limestone? I'm just curious. I know you work right next door. Maybe some stock? She wasn't a bad employee, she was there 9 years. Problem was, once they started cutting ppl in her department, they never hired on and just added to her plate with no incentive. I felt bad for her. I know ppl can exaggerate about their jobs/position, but I believe a lot of the stuff she says.
