It says the funds were secured by a private foundation (ok), yet it also appears this is an official governmental policy/program (not ok)? I'm not entirely sure how this would be permitted under the 14th Amendment. It certainly doesn't fit any of the currently recognized "compelling government interests" necessary to justify explicitly race-based policies. And I'm not opining about the wisdom or benefits of the program, just the current state of Constitutional law. It seems to me that a new "compelling government interest" would need to be recognized in order to avoid running afoul of the Equal Protection Clause. That may be possible in the lower courts, but the Supreme Court has not recognized a new "compelling government interest" since the very early 1980's, I believe. I could be wrong about that. This is a long-winded way of saying that I predict this policy would be declared unconstitutional if it ever worked its way up to the high court.

and really there's plenty of reasons to not like this project that don't consider shadows - I think the main one is none of the units have kitchens and people are just worried they'll be airbnb's.

thanks for the correction and additional information.  that makes the situation appear less ridiculous, but in some ways worse (zoning says you can only build multi-unit housing here if units are one room, no kitchen -> commission meeting: all commissioners yell at them for not having kitchens in their tiny one room units).

it was someone encouraging/surprising that most of the comments seemed to be in support of the development.
