Guess I am a very strong supporter of the 1st amendment. I think Birthers are no better than the fools that thought Bush caused 9/11 or stole the election in 2000 but I am damn proud that they are allowed to speak there minds and opinions, how ever misguided without the government punishing them.

You don't have 1st amendment protection in this situation.

Here's  a hypothetical that should illustrate the dilemma.


You are spokes person for Cargill's pork division.  You decide to start a public awareness campaign against pork, declaring it to be unhealthy and advocating that no one consume pork.  Is it within Cargil's right to fire you?

The problem is he is a public representative of the university and so his actions are perceived as a projection of kstate's values. A better analogy is Fitz getting dropped from gameday.

Cargill is a private corporation. K-State is a Public institution. 1st amendment protects people from the government from infringing on the rights of us citizens to speak our minds. Out-right firing him for what he is doing would be a violation of that right because K-State is a branch of the government.

You have no constitutional rights to a job. Unless the government is coming in and charging Montgomery with some crime for doing what he is doing, his rights are not being violated. As his employer, K-State is completely within its rights to fire his ass for making them look like a backwards, hayseed institution to the entire country. They did not fire him, but they should have. It would be worth being sued over to not have the K-State name associated with this.

I mean, what if he, as an ambassador and "voice" of K-State publicly declared he thought Obama was a space alien...never mind. It would actually be less embarrassing if he thought that. So, bad example.

making his employer look bad (especially when the employer needs to market itself like KState does) is a 100% valid reason to fire someone. The first amendment protects his right to say what he wants, which is why he's allowed to continue to say whatever he wants to his heart's content. however, the first amendment does not protect him from anything his free speech causes. his job being a govt. job has absolutely nothing to do with it.

So a branch of the Government has a right to fire a person over his speech? What about Ward Churchill and his stuff a few years back. They only got rid of him because they found out he plagiarized a bunch of his papers and thus violated his integrity clause of his contract with Colorado.

It seems to me that he tried to claim his first amendment rights were violated and then he got mushed by the supreme court.
