I don't have access to the newspaper article, but I imagine it's the same thing. He hasn't been paying his bills, any of them. Which I guess is common practice for Mr. Wilson? Now, the bank is taking him to court for the money they're owed.

I figured this was common knowledge, as my co-worker (an ex-business partner of Rusty), has been telling me about it for the last two months. I guess, all I was trying to say was that I was surprised it was just now finding it's way into print.

If he rents, the bank wouldn't be foreclosing on the property, i.e. taking ownership of that space in the building.  Looks like he put up "Kite's" as collateral which would be the “accounts, inventory, equipment, fixtures and general intangibles.”  Not sure what that's worth.  Anyway, foreclosure is probably just one remedy and that's the newsworthy word.  They want a judgment for the money he owes them.  He's probably defaulted on a loan that has an acceleration clause whereby they can sue for the entirety of what he owes even if it wouldn't all have been due yet had he made his payments on time.  Doubtful he has a defense, but he probably hopes to show them that pushing balls out with the suit won't produce them the cash they want and thus they should let him get back on a new loan.

If the other collateral aside from "foreclosing on Kite's" would get them the money, they could tell him to go eff himself, provided of course they had him personally guarantee the loans so that he can't just fold up his corporations and escape.  He could always file bankruptcy and probably come out OK.  He doesn't look like the kind of guy who'd be afraid of having that stigma.

Actually, our other mini-BSAC may have a service that can get the actual documents from those cases online.  Not sure.  If not, yeah, you just go and look at the file.  I'm not sure if they have paper files still to check out or if everything's online or what they're charging now for copies.  Depending on what you found, I may have a way to get some of it cheaper.  Of course, if they let you look at the paper files, you can always take a relatively good pic with your phone or ipad.  I know there's apps to convert pics to pdf for these very purposes.

When KK gets the documents, we'll know a little bit better what he had as collateral and why they'd do it.  Like I said, it sounds newsworthy that Kite's in Aggieville (great burgers) could be foreclosed on, but I doubt that's the goal of the bank or where they envision getting paid from.

They need to charge more for the best burgers in the country.  The chef at my resort charges $20 for wagyu burgers and they haven't won any sort of online poll that I'm aware of.  I don't believe Will Ferrell has had on either.

Word in the industry is that he somehow was able to use one location as collateral for all these loans...do not know specifics as to which building was used as collateral, but the industry (food & beverage) doesn't think he can survive this without taking on a money guy...looks like Johnny Kaws Raves will rule Aggieville  :weirdrobert: :kstategrad:

As a side note, just about anytime you see a independent chain of restaurants open several locations that aren't franchises in a short period of time, they are mumped or doing something illegal. There is a big one in the KC area that I've got my eyes on because they are doing this now... :dubious:

yes it is open, was very strange.. Its a lot nicer and some cooler lighting decor didn't check the bathroom but there is no outdoor bar anymore seemed weird just a huge space with nothing but a few tables. So yes it still sucks.. Oh also it was very white in there.... very.. like I was a little confused as to how white it was.

As a general rule for restaurants
-If you consistently have lines stretching outside at all times of the day/week and are consistently featured in various food/travel magazines/shows you are probably safe to expand from 1 location to 3 in 10 years.

Yeah. Works much better out in South JoCo, where middle-aged guys can go obliterate their senses with sports on TV at the 810 Zone or pretend to take their family out to a nice dinner at the new Moose at 135th or in Lenexa.  Always felt weird on the Plaza.

Most definitely not Johnny's...I worked for Johnny's for 5 years after college & am still good friends with all owners. Those guys have their crap together, the last 3 stores that've opened (P&L, 95th & Antioch & K-10/Ridgeview) put up GREAT #'s...in fact, I explored the option of buying one of their older locations a couple months ago to accomplish my dream of destroying all KU crap in there & replacing it with EMAW

Sometimes the settlement is included in the dismissal order, sometimes it isn't.  Even if not, the actual dismissal order will more accurately show that the bank got some sort of satisfaction and then voluntarily dismissed THIS case with prejudice, rather than Rusty "winning."

I'm curious whether Rusty just got right with them for now and is back on his loan schedule (meaning this will happen again when he defaults again) or if he somehow settled up the whole loan or got somebody to pay it off and owe from now on.

Riffel, the owner of the properties, guaranteed the bank they would get their money. Grumblings that he put up his family farm as collateral until P.O.S. Rusty gets back on schedule with his loan payments.

Alright, alright.

So my family moved to a different house in Manhattan when I was in 8th grade. The house was previously owned by the Fritchen family. Years later, when I was an engineering student and had a reason to know/care who Dave/D Scott Fritchen were, my dad told me this story.

When we first moved in to the house, I picked this room with a weird little unfinished attic/closet connected to it. This was, allegedly, D Scott's room when he had lived there with his parents. My dad and I decided it would be cool to finish out the attic space with carpet, drywall, etc. So one day, my dad was in there securing loose pieces of OSB on the floor and saw something in the space below the floor and the ceiling of the lower level. He reached in and pulled out a crumpled up pair of nasty red panties that had been stashed underneath the floor boards. To this day, those panties are the first thing that I think of whenever anyone mentions D Scott.

Here is what I know. There was no "peeping." That's Rusty being a drunken little doink. Apparently Rusty set up the changing room for his Beauty on the Beach contest in his Legends location with the lights on, in full view of the bars across the street. So a lot of people, men & women, were able to see.

 So, I'm sure Rusty was pissed that Fritchen called him out on that, but Rusty is the same guy who in an intoxicated state tried to charge into our office and force his way in (still one of the funniest things ever). He's not exactly stable and rational when partying.

 Beyond that, I'm not sure what happened but receiving a lifetime ban from Rusty's & Kite's sounds less like punishment and more like a favor. I think more people should self ban themselves from there. And lifetime is relative. It's not like Rusty will keep his house of cards standing much longer but that's an entirely different story.

It's like Manhattan can't ever hold a bikini contest without some sort of drama.  I'm glad we collectively nixed such contests from the FattyFest schedules years ago, no matter how badly Pete insisted they be included.

My guess is DScott and his boys were on or across the street and saw that Legends' lights were on and that it was weird as there was no event scheduled, and that rather than just noting it and continuing to drink responsibly, DScott did some deeper investigation.  He might've even had the same recorder on hand that he uses for his hoops reporting.
