Well, the regulations specify that you must be a resident for one year while not attending school to gain in-state status.  An old GF of mine had to research the hell out of this as she was an out of state and attempted to change her status before attending law school.  Her dad (a judge) was unable to find a legal way for this to happen.  I mean, I can snoke rock on the street corner if I wanted to, it just requires a few silly steps...
