These guys and gals are all experienced business litigators with bigtime credentials, and you can't just gaslight them. It may take 2 years to get through the motion to dismiss phase and discovery, but they're surprisingly efficient at whipping a case to trial even in these highly complex cases. They love trials and frequently deny requests to file motions for summary judgment (in lieu of a trial). It will be interesting to see which Vice Chancellor is assigned to the case, as some are more plaintiff-friendly than others. Texas is exploring setting up a similar complex business litigation court, and I'm here for it, because your run-of-the-mill state court judges suck butt.
Spracne or someone else can correct me here but my understanding is that the DE court does NOT eff around in business dealings. It’s 100% their thing and they will 100% assure it remains their thing. Correct?
