How did he not tell his client that he accidentally distributed ALL of his communications? Like, obviously there's a lot going on in the video, but to let your client find out about that little whoopsy on the stand during cross? 

I'm trying to think of some 4D chess explanations, but I can't imagine a lawyer knowingly and publicly ruining his career just to delay the inevitable.

It had to be intentional, IMO.  I don't think it was growing a conscience either, I think it was having to be in a room with Alex Jones so much that they wanted the absolute worst for him.

Yeah, none.  I don't know enough about the case at all to know whether this would be an open-shut legit malpractice claim, but I gotta think it's at least a pretty serious ethical violation.

Very true but, if the texts are just between Alex, Chachi, Lin Woods, Randy Quaid and Don Jr. what is the basis for a clawback?  He inadvertently produced texts that should have been produced in the course of discovery before trial.

It sounds like in response to RPD or questioning he said there are none and now it is proven that there are.  I would have tuned over text messages that are responsive to a request and not excluded pursuant to a valid objection or privilege.

Yeah you gotta produce the validly responsive texts, but turning over all the texts carte blanche is a pretty big fuckup that would definitely be subject to clawback.

And not telling Jones about it and waiting for him to get roasted on the stand is, to me, the most obvious ethical violation (even if it doesn't quite reach malpractice for any number of reasons).

Do lawyers carry malpractice insurance or something like that by a diff name?  If so, I assume Alex will sue the eff out of his atty and the parents will soon be grabbing that from him.

I don’t see a clear malpractice claim from that exchange. Producing non-responsive material is not grounds for clawback, and his attorney may simply have determined there wasn’t any privileged information in the texts.

Not to mention that the fact the overeager attorney on the other side called it a mistake doesn’t mean it was one. It may have actually been a strategy intended to bury the actual good stuff, in which case it’s arguably sanctionable but not malpractice.

Totally guessing, but my theory is ol’ Alex said in a deposition he didn’t have texts related to Sandy Hook, his attorney later determined that was false, and in their best attempt to cover their tracks just dumped the entire phone’s contents on the other side.
