It seems like a junior high would have more trouble winning than a university.
Nah.  College students have more speech protection.  Free exchange of ideas more associated with university setting than in lower levels.  Junk like that.

Universities have a lot more leeway with admissions, though. Wouldn't they also have more leeway with who gets to stay? It would be interesting. I hope they challenge OU in court, just so we can see what happens.

From a PR perspective, the announcement of an expulsion this quickly was a pretty good move even if they would lose in court. Seems silly to expel just two members when it's clearly a much larger problem, but still a good PR move.

The president's immediate response to this situation really helped saved this from being an OU issue rather than an SAE issue, as it was. Good work by them.

won't happen, SAE @ OU is reportedly full of private school kids and I doubt they want any further embarrassment - shaggy tells me the guy standing up and leading the song is from Dallas Jesuit (I assume fairly similar to Rockhurst but maybe worse without the few working class Catholic kids.)

It's a tough call.  You have 3 options.

1.) Don't fight it.  Enroll elsewhere, get a degree, try to start a career, hope HR doesn't know how to use Google.  I guess it depends what type of work you want to go into and if you plan to pursue a graduate degree.  Being expelled from a university raises a lot of red flags and will come up in the admissions process for grad school.

2.) Fight it, but ultimately lose.  Congrats, racist bad person, you are now a racist of the highest profile.

3.) Fight it, and ultimately win.  People still think you're a racist, but at least you fought to defend your constitutional rights.  Maybe your flippant remarks will someday protect an innocent person from a tyrannical institution elsewhere.  You now have one hell of a person statement to write about how you were careless in your youth but eventually grew into the well-adjusted man you now are while fighting for the preservation of the American Constitution.

When I was in a fraternity, our limerick was about how SAE are a bunch of homos. There was a guy that came out as gay in the fraternity. He didn't cry about it.

I am living in Asia. I have white friends, and they'll sometimes talk crap about locals, how they always try to cockblock, how they always dress a bit homo, small penis, etc. While I share the same race as locals, I don't identify with them. I don't cry about it, in fact I join in.

Growing up I probably heard more racist stuff to my face than most black people. Asians face a lot of issues in the workplace and socially as well. But most Asians work their asses off instead of asking for handouts:

The victim mentality (which MIR seems to advocate) and having to be super politically correct in America these days has become ridiculous.
