If she were to put in notice and they say no thanks and bounce her immediately she could apply for un-employment. probably not worth it for two weeks of pay as they would fight it and she would have to go stand in line with all the gross people.

Yeah, I think she's really worried about it. I mean, her present company has had so many recent changes and she's like almost the only one left. They still have to pay out her vacatio tho, right?

depends on the employment contract. Unless her current employer was a complete piece of crap they generally do. When i left my last job i had way over the limit of vacation hours like close to four weeks and they still paid me for all of it. <---- #fanningbrag

That's good to know. I mean, she was with them for 9 years and they're a sinking ship. You'd think they'd be courteous enough to do it the right way.

 In my experience,  I have seen more ppl bounced the day they gave notice than those who actually worked through their notice period.  However, last time I moved jobs, I gave a months notice and worked it all.

How crucial is what she does?  Could someone else pick it up easily?

Oh man, free trips to India and Hong Kong and she doesn't even have to do any work while there since she'll be gone right after and the lack of accomplishment will not affect her.

mrs hubs was literally just freaking out about this exact same thing the other day.  I believe it depends on the state, but assuming this is at-will employment and not contract, then unless there is a provision in her new hire manual that states the company can refuse to pay out accrued vacation then they have to pay it.  And if they change that policy they have to notify the employees in writing.  I don't believe they have to pay out any un-used sick days unless the sick days are all rolled into the PTO.  Some companies split out sick time from PTO because the sick time won't roll over to the next FY.

If she puts in her 2 weeks and they tell her to kindly hit the bricks, then hopefully her pay is staggered by a week so at the least she will receive her next paycheck plus a partial check for time worked on the current pay period.

Also...mrs wacky isn't....mrs hubs???

I think a two week notice becoming a 1 month notice is fairly common...especially when it comes to the harder to replace type of employees, which it sounds like she is.  I can boast a squeaky clean track record of current and former employers having nothing but compliments to say about me, (<==fanningbrag) and my advice would be: don't burn bridges, she will almost certainly find that she will encounter these people again and she'll be glad she didn't do something to alienate herself.  Unless her new job hinges on her starting before the first of december...she should stay on til end of november.  Current boss will appreciate her not leaving them high and dry and that goes a long way.

Also wacky sorry we married the same woman and didn't realize it til just now.  This is just so embarrassing.  :frown:
