Title IX KU investigation (ugly)
« on: September 02, 2014, 08:07:25 PM »
http://www.huffingtonpost.com/2014/09/02/university-of-kansas-rape_n_5731668.html

I sincerely hope our IOC, student affairs, campus police, RCPD, DA, Title IX enforcement chair, Pat Bosco and university general counsel are not all this incompetent/evil.  I also hope our policies put morons like those featured in the article in a position where they are likely to be forced to do the right thing.

@trim feel free to summarize how your depo/prosecution of this awful person would go.

Why is any uni charged with handling a crime?  They aren't independent entities seperate from the laws that govern the area around them.  A uni's response should be to let the authorities sort it out, separate the offender and victim until the law sorts it out, then act accordingly once the process is taken care of by a court.  The idea that they can review, investigate, and punish things like rape is outrageous.

thats pretty bad, the fact she couldnt really go anywhere for help is just sad.  also makes you think that al jazeera video could have featured administrators who feel the same way the students featured do

Yeah, that was appalling. I'd be interested to go inside the mind of an attorney to see if there is an internal struggle to publicly mount a defense like that.

Do we have any info on K-State's title IX issue?

Universities have a duty to proactively prevent their campuses from becoming hostile environments.  If they are shown to be negligent and it can be shown they have persistently allowed a hostile environment to exist, they may as well shut up shop because besides the fact that employees and/or students will be deprived of a professional/educational environment they will be sued extensively.

The police officer and the DA's handling of the rape is more disturbing, but the University response was bad too.

This is all I found on Google. Looks like not making any big comments on it yet, which is as to be expected.

There was a quote in there when one of the KU admin guys was defending the punishment when he said something along the lines of "This is consistent with past instances" or something like that.  So, yeah.

Douglas County District Attorney Charles Branson decided by the end of October 2013 not to press charges, despite the man's confession, because there was a less than 1 percent chance a jury would convict, according to the woman's family.

Unconfident loser.

Universities should not be in the business of law enforcement. When they do get involved, they generally do a shitty job. People should be upset with the DA - not KU.
I've said it before and I'll say it again, K-State fans could have beheaded the entire KU team at midcourt, and K-State fans would be celebrating it this morning.  They are the ISIS of Big 12 fanbases.

On the other hand, when the university decides that a man did in fact rape a woman, they probably shouldn't take the stance that community service is too punitive.

A university shouldn't be "deciding that a man did in fact rape a woman" (1) without due process, and (2) after law enforcement has already declined to prosecute. Rape is a felony crime. Universities should leave prosecution of crime to the professionals, not education administrators with little to no legal experience.

The Lawrence DA, btw, does not have a reputation for being light-handed. If they declined to prosecute, I suspect there may be more to the story than what is being reported on HuffPo.

They don't have to prosecute a crime to kick an admitted racist out of their school.

A racist too, or just a rapist? Regardless, I'm not comfortable with school administrators playing judge and jury in such serious matters. It's more appropriate to immediately turn the matter over to law enforcement and take action, if any, based on law enforcement's decision.
