Judges are people, they have personal feelings. You hope that they can put those feelings aside and look at each case based on merit and law.

Plus, I'd say Clarence Thomas recieving 1.6 million dollars from anti health care groups is much more concerning.

Plus, I'd say Clarence Thomas recieving 1.6 million dollars from anti health care groups is much more concerning.  

Every judge has an ideology. That's not the issue. Kagan cheered for the passage of a specific bill that she is now going to preside over.

I hadn't heard that Clarence Thomas accepted $1.6 million from "anti health care groups" (who opposes health care? Christian Scientists?). That sounds like a bribe, and if true, he should not only recuse himself, he should be removed from office.

Its really no different than Obama suddenly becoming a SC Justice and hearing the case. She was his solicitor general during the time they were drafting the bill, so is she going to say she gave bad advice as to the constitutionality of the bill she helped formulate? No.

she has a history of recusing herrself from cases she was involved with as Solicitor General so it will be interesting to see how she handles this case.

The CT talking point is beyond Fake Sugar Dick (WARNING, NOT THE REAL SUGAR DICK!) and nothing but a bunch of libs looking for smoke when there is none.  It's not a conflict under any interp of judicial prof resp.  Sorry, libs.  I would actually think the ACLU would be out bashing the people saying it is.  What, is a woman supposed to stay in the home and not work?  Was she supposed to know 10 years ago that that in 10 years her husband would be forced to rule on a law passed by Congress and the POTUS that was so terribly written and so intrusive on society that it actually makes it to the SCOTUS on constitutional grounds?  GMAFB people.  Think for once in your life.

Agree with all of this, except that Kagan will not recuse, nor will she be removed. It's just another embarrassment for the liberal justices. I think the e-mail is amusing, more than anything. I mean, people such as Tribe and Kagan are clearly quite intelligent, yet they have these ridiculously naive exchanges in their private communications. My favorite part was the subject line of the e-mail: "Keep your fingers and toes crossed" or something like that. "Oh LArry, can ya believe it? THEY'VE GOT THE VOTES! Oh blessed day! All will be well!"
