MANHATTAN, Kan. | The Kansas State athletic department is confident it has committed no wrongdoing in a lack of state sales tax being applied to merchandise sold through its online store.
The Wildcats sell apparel through a website that is managed by Florida-based Team Fan Shop, which handles online sales for athletic departments and conferences across the country. Because it has no offices or employees in Kansas, Team Fan Shop is within its rights to not tax online sales, K-State officials say.
On Monday, the Lawrence Journal-World reported that the Kansas Department of Revenue was looking into K-State’s online sales practices. Although it says it is up to Team Fan Shop whether to begin taxing online sales, the department issued a statement saying it will help the company decide.
“Team Fan Shop’s tax advisers believe it is in compliance with Kansas tax laws,” the statement read. “However, Team Fan Shop and K-State athletics are conducting additional research into the matter. If it is determined that Team Fan Shop should collect sales tax, it will comply.”
Brian Swallow, vice president of sales and marketing for Team Fan Shop, did not return a message seeking comment.
According to a university spokesman,
K-State sold merchandise worth $131,539.08 on its online store last fiscal year. Of that revenue, Kansas residents were responsible for $56,104.94 of the purchases.If sales tax had been applied, K-State would have owed close to an extra $5,000 in taxes.
