The sad thing about ku fans is that they get so darn feisty when there's any sort of impropriety surrounding their basketball program. Yet we all know that most D1 programs cheat on some level, some more than others (like ku) and for the most part the NCAA is going to look past stuff at schools like ku, because basketball is what butters the NCAA's muffin.
ku fans should just embrace the cesspool their basketball program is immersed in, it should be a point of pride.
But no, their massive tuck fanbase comes unhinged. My lawd, they literally got away with a ticket money laundering scheme that sent 4 ku athletic department employee's to federal prison . . . yet anyone with a brain knows that money was used as a recruiting slush fund. dax, it doesn't matter if McLemore benefited or not. The NCAA rule regarding this sort of thing says that if a player is knowingly shopped he is automatically ineligible, regardless of whether or not he or the person who sells him ever actually receives any benefits. I remember this quite clearly from the Cam Newton ordeal. Auburn got off on a technicality because the NCAA ridiculously believed that Cam Newton couldn't be linked to his own father, who tried to auction him off. "Knowingly" is what saved Auburn's ass and that will probably also save McLemore/KU.

Both. But KU clearly can't be expected to monitor who receives each of the players 4 tickets 20 times per year to ensure NCAA compliance. I mean, that would involve employing at least 0.1 FTE during the basketball season to say "who is that" and operating Google after saying "write their name here" in order to make sure your players are amateurs.
