i'm not at all plugged in on the situation, but was he in a position of power over the female student in question? that distinction usually changes things. imo, this is between himself and his wife, the woman he had an affair with, and the normal media scrutiny that comes with a relatively public figure in an affair.

The first thing that struck me is that the announcement didn't identify gender, which seems a little odd.
Secondly, when its two adults involved (outside of a high school senior), there's no distinction between a position of power. It's perfectly legal for a boss/secretary to bang at the office. Now it may be against company policy, but it's not illegal.

I agree on your first point, but I don't think UT getting sued means Dodds is getting canned. they'll settle out of court and it will all be taken care of.

Does it say anything to effect of whether the student was working in the athletics dept? I would think there is a big difference between banging an athlete you coach, banging a fellow employee, and banging a random student.

Rumors now that she was part of the Sports Medicine team that went to the game. Picture floating around of her on the field at the Fiesta Bowl in her UT Sports Medicine polo.
The more I think about the, the much more likely it is that she was part of the traveling squad. Unless Major just really, really wanted to cheat on his 9-month pregnant wife and saw the cover of Phoenix as the perfect place to do it, it makes much more sense that in a busy bowl week if he was going to nail someone it would be someone he already had a relationship with.

I understand and agree with that, but the post I quoted wasn't about if Major should be fired or Kearney should be settled with. It was about if Dodds can be hung for the combo of the Major not firing/Kearney firing situation. I don't think you can hang Dodds because he didn't fire Major 4 years ago, then 4 years later the women's AD and UP decided to fire the women's track coach. It appears to me the statement that Dodds fired the women's track coach is not correct. That's all. Part of the basis of the lawsuit will be unfair treatment because Major wasn't fired 4 years earlier and she was. That's on the UP, not Dodds.

@mikefinger: UT regents release statement saying they learned of Applewhite reprimand "with great disappointment and sadness."
Seems like they're surprised and pissed about the punishment major received.
