LAWRENCE, Kan. (AP) -- Prosecutors have agreed to dismiss drunken-driving charges against Kansas guard Brady Morningstar if he stays out of trouble for the next year.

The 23-year-old Morningstar was arrested Oct. 3 on the Kansas Turnpike near Lawrence on suspicion of driving under the influence. Court records indicate that the junior had nearly twice the legal limit of alcohol in his system at the time.

He was fined $500 and charges included speeding and failing to keep his car in a single lane. Douglas County prosecutors say all charges will be dismissed if Morningstar does not have any further legal problems in the next 12 months.

That's just diversion.  Any first time offender can get it.  I'd say 99% of first time DUIs go like that if there is no injury and a lawyer is hired.   :rolleyes:

Not entirely sure that's true.

EDT: after looking it up, you are right. i thought I remember hearing that KS was doing away with DUI diversions.

I don't believe they're doing away with diversions for first DUIs.  They get everything they really want ($$$$) from you and don't have to clog up the jails with mandatory jailtime for the first offenders.  Pretty sure they are adding mandatory day to 2nd and subsequent DUIs, that may be what you're thinking about because it's ben in the papers quite a bit lately.

That's not the point you were making. To quote: "that tends to be the norm in a diversion". That has nothing to do with a diversion. You would be surprised just how much legal info cops have. Cause, oddly enough, cops have to make those legal decisions in seconds, not the billable hours that attorneys do.
