Statement by Neil Cornrich & NC Sports, LLC.

May 20, 2009, BEACHWOOD, OHIO -- Coach Ron Prince entered into a legally binding contract with Kansas State University (“KSU”) and the Intercollegiate Athletic Council of Kansas State University, Inc. (“IAC”). IAC now seeks to repudiate a contract that it drafted and that Coach Prince negotiated in good faith in an openly disclosed format with the authorized agents and representatives of IAC and KSU, including its Athletic Director. It is unfortunate that KSU and IAC have chosen to unfairly involve Coach Ron Prince in their private dispute with the former Director of Athletics at KSU and CEO of IAC, Bob Krause. Not only is it inaccurate to claim that this was a secret agreement, but also it makes no sense since the contract was mutually agreed upon, signed and legally binding. Consequently, the legal position taken by KSU and IAC in this matter is without merit and will be exposed as such should they continue to pursue their present course of action. -- Neil Cornrich & NC Sports, LLC.

Ron's camp: the AD is an authorized agent of KSU and IAC, he (and possibly others) were aware of this contract, Ron had no reason to believe the AD wasn't authorized to make this negotiation, take it up with Bob (the authorized agent) not Ron if you have a problem.

KSU: Bob didn't have authority to make this contract, KSU (the principal) was never made aware of this contract, Bob broke his fiduciary duty.

Hopefully they just settle (again).

So if this is the starting line, and a legal case is a marathon to get a jury verdict/judgment, how many times will KSU trip, fall, try to drop out, cry, mistake a hot cup of tea for water before they get to the finish line?  How badly will they screw up the litigation?

Let's hope they outsource this and take it out of the hands of either in house (university) counsel or some hillbillies in Olathe or some crap.  Hire a real firm with real lawyers or you will get stomped (again).

The real interesting thing is that nobody seems to know who the group is (In Pursuit of Perfection) that is set to receive the money. I'm wondering if this is a front. Where was this money headed? Does Krause have an interest? The fact that the payments were to start so long after the contract expired suggests they may have been hoping nobody noticed this little transaction until it was way too late.

Aside from the argument that the negotiations were secret and invalid, the university is also arguing that IPP (In Pursuit of Perfection) did not exist when the contract was signed, and that it did not exist when Prince was fired. They argue that contracts with fictional organizations who are headed by nobody are not valid.
