There's a constitutional mandated presumption of innocence in a criminal case for good reason. And, there's a good reason why the constitution demands proof beyond a reasonable doubt to convict a person of a crime. The only legal standard to bind a person over for a trial at a preliminary hearing is "probable cause"--which means "any evidence". Not a preponderance of the evidence. Not clear and convincing evidence. And, not proof beyond a reasonable doubt. The judge is not permitted to weigh the evidence at the preliminary hearing. This young man has not been convicted of anything. He's guaranteed a fair trial based upon the evidence produced at the trial of the case with all the constitutionally mandated rights strictly adhererd to in that trial. So, let's put away the rope and wait patiently for the results of that fair trial.

I think they should charge him with attempted murder. Only two things can result from shaking a baby: brain damage and death. Leon Patton, you are a miserable excuse for a human being.

Thank you Jon. Innocent until proven guilty is always good to remember.
It's sad to think of the number of people negatively affected thus far from this situation.

I agree this young man is innocent until proven guilty.

<If convicted, Patton could be sentenced to 31 months in prison, with possible probation.> This seems like a very light sentence if the severe brain damage affects the baby for life.

I am all for innocent until proven guilty. IF he did do this he should have to take total care of this child. Change diapers, feed, total care for the rest of his life.
