Before anyone turns me over to the authorities for advocacy of a child rapist, I'm fine with Jared's sentence. Boys and girls get different treatment under these laws. Should they? Yeah, I think so. Girls are more vulnerable than boys. If that's a "sexist" point of view then so be it.

But I do think it's a bit rich if the same people say "meh, it's just statutory rape for the boy" and "zomg, Subway Jared raped those girls!"

i think so too, but that's because men and women are not equal (neither is better though). the issue though is the whole thing about feminists pushing to be equal but really picking and choosing the laws that benefit women.

Actually, it can be, so long as the law in question is substantially related to an important government interest. With respect to gender classifications, the Court has specifically held that statutory rape laws that apply different standards to males and females can be constitutional.

It was a plurality opinion and hasn't been influential since, but there have been other cases where the Court has made it clear that some policies that apply different standards based on gender are constitutional. (see: Nguyen v. INS.) The important factor is that the law/policy is based on actual differences between the sexes  (not stereotypes) and is substantially related to important government interests.
