How is this dude not in jail, right this second?

Eh, we're going to imprison people for using figurative language to make a different point? This was not a violent threat or incitement to violence. Did you watch the video? The quoted portion in the tweet cuts off right before he gets to his actual point, which, while dumb and lacking adequate foundation, does not sound like a call to violence to me. Dr. Fauci has long been a Shibboleth in the MAGA movement.
I did. Is Watters getting a pass because he's a television personality? Would this be taken differently if this was a nondescript proud boy speaking like this about Kamala Harris? From a legal perspective can there be consideration made to the perceived intent of the message to the people receiving it?
If I sent a letter to a group of antifa and it said in 48 point font, "you should murder republican politician x, walk right up to him and shoot him in the face." Then on the back of the letter in 4 point font say "with your words of dissatisfaction, really let him have it and eat garlic before you do so." Would I be held to the same standard?
He's an articulate dude and that language seemed loaded and intentional to me. There are a billion ways he could have better made that point without seemingly inciting violence.
