Collateral estoppel can apply a ruling in one case against other parties in privity with the party receiving the adverse ruling. Obviously there are plenty of nuances you can argue over but I’d bet a good lawyer could make the case.

Damn you all. Especially you, cat, because you should know better. Offensive nonmutual collateral estoppel, as here, can only ever be used by private litigants. It is not available to the government or in criminal cases. If you ask me, it should never be used bc due process.

yeah. It would be a pretty bad system that allowed facts found in a roll over plea deal to be used in a criminal court when a party is not represented and has no opportunity to cross exam.

Well I have no issues with that statement but what do you mean “as here”? The tweet suggests a hypothetical and doesn’t use any of those words. It suggests that the fact finding process may put Trump in a position where the executive privilege may be waived/broken whether he tries to interject in the proceedings or not since they concern him.

I did not read it as saying the government would use the findings to prosecute him. I thought it was pretty well accepted that won’t happen regardless of what the government finds.
