I'm just not sure how kicking her out can be reconciled with the First Amendment.

That said, from what I can tell, she's a lousy person and I don't find her very sympathetic.

I mean, you know more about First Amendment stuff than me, but that was definitely hate speech. Not sure if that matters.

Explain to me how a state actor can punish this Hate Speech in a way that is consistent with First Amendment jurisprudence. What exactly is Hate Speech, in your own words? I find the entire notion of a state actor punishing speech which is not a threat and not directed at an individual who is present to be as repulsive as I find this dumb girl's stupid remarks.

I could get indignant about First Amendment rights potentially being violated, and usually I do, but honestly it’s hard for me to muster any fucks to give about that girl after watching those videos. Also I’m not usually a guy who immediately leaps to the “we must find the most drastic possible punishment and deploy it immediately so as to ruin this person’s career/life,” but, well, here we are. She’s awful and she can go suck an egg.

hadn't watched the video yet, i dont really understand the context of her rant.  I know its foolish to try to understand her logic but she seemed to think that coming from new jersey entitled her to the racial slur she was using or that maybe her location in the south meant she was safe using it.  Also interesting that her detractors were told to buy her a fur coat from neiman marcus.

So what would happen if she were to decide to sue the university for a violation of her first amendment rights? Would they just have to let her back in, or would they also potentially owe her a lot of money? It seems to me that it would be pretty difficult for her to justify damages beyond the cost of her tuition, but I really don't know anything about this sort of thing.

Whatever it costs Alabama to resolve any alleged wrong in expelling her will have been worth the money.

People are talking about whether it was right or wrong for Alabama to fight racism in the form of expelling her, instead of how this girl showed up from NJ and subsequently became a public racist, emboldened by now being part of "the south" and specifically U of Alabama and seemingly cheered on by at least 2 fellow students.

If it costs some hassle/money to settle up some claim by the expelled girl in exchange for having the narrative be what it is, that's a hell of a deal.  Not quite the deal BSAC pulled off to secure EMAW, but still.

I think pretty much every college has had incidents like this -- be they blackface, k-state's "Kool Kids Klub," or whatever.  I think this speaks much more about this girl and her upbringing than it does about the university or the region. 

She's not even from Alabama.  Her perception of what "the South" is is what made her feel emboldened.
