The quarterback should have to declare whether the play is a pass or run prior to the snap.
in the end, EMAW will always win.
The ESPN article doesn't mention it but the Oklahoman talked about how the officials usually don't call it so long as the contact from the block is initiated within 3 yards.

They allow, you know, these run-pass options, and it really gets to be almost impossible defensively when they're blockin' downfield but still able to throw the football.
Again, another one of the same run-pass options, but this time they call them for illegal blocking downfield, as was the last case, but fortunately that time they called it.
