The idea of regulation is dumb.  Charge them tax and call it a day.  Is this all about the cost of a biz license or is it more than that?

Nobody can get a straight answer from Uber....sounds like they want to lower the barrier of entry as much as possible to recruit part time drivers...they say they are okay with background checks, insurance, etc. but are always unwilling to share with cities the result of their own checks....which forces the cities to request new background checks, etc. from drivers....

Like most industries, if there is an issue with the drivers' insurance, I would assume the liability would roll up to Uber as the employer/contractor.

a background check doesn't do anything if there aren't disqualifying factors.  i mean has kc said no former rapers or robbers or molesters?  no felon uberers?

Lyft has basically said they are now coming to KC (they were in a lawsuit before)....Uber won't leave.  they may not obey the rules but cabs haven't been for decades with little recourse.

most personal auto policies exclude coverage when the driver is carrying passengers for a fee.  I believe uber provides $1 million in liability coverage on the drivers.  so uber would cover injuries/property damage caused by the accident but not the damage to the drivers car itself...and his insurance would also exclude it.  so basically the driver gets mumped the hardest.

actually I was wrong, they have a pretty robust insurance policy for their drivers.  not really sure what the city's deal is if they're worried about insurance.  seems more like they just want the fees like they get from the taxis.

the only gap there is if the driver is "on call" and doesn't have a passenger in the car, they wouldn't have the contingent comp/collision coverage, but they still are covered for liability by uber if denied by their own carrier (they would be denied by their own carrier in that scenario).  so as a driver you're basically taking that risk but other than that it's really not bad.

"appropriate insurance" would be a commercial auto policy which is obscenely expensive and not realistic for a part time driver.  uber would cover the damage to the customer (injuries) and the other vehicle if denied by the primary carrier, so that's not really an issue.

This is probably the best summary I've seen. I've been told by a source very close to the situation (not directly on either "team") that Uber is the "bad guy" here.
