To me, if the thing can walk it's no longer a baby, but I could be swayed with the bathroom argument

the line must be drawn somewhere, its either a baby, or its not

Actually, I also question the existence of a line. A baby can be whatever you want it to be at that moment in time. That can change depending on your mood, the young human's mood, the setting, etc.
