What happens if you just say: "I want to talk to my lawyer first?"
You can't. You don't have the right to speak to an attorney until after you've been placed into custody. You have to cooperate with the Police Officer during his initial investigation of the potential crime.
I know a guy that got a DUI when he jumped in his car, put the keys in the ignition and then passed out without starting the car so I'm skeptical about the slamming beers after the cop pulls you over trick. Not sure if he tried to fight it or just took the diversion.
The cop has to actually witness the person slamming the alcohol and have evidence at the scene. Simply passing out at the wheel before actually driving anywhere, while admirable, is Fake Sugar Dick (WARNING, NOT THE REAL SUGAR DICK!).
