The goal of any business is to make money and insurance companies are no exception.  It is important that you don't forget this when dealing with them.  They don't care about you, your wife, or anyone else, they only care about making money.

As a plaintiff's attorney, I represent folks in personal injury and wrongful death cases every day.  Conversely my wife works for a large law firm and represents people who are being sued in personal injury and wrongful death cases every day.  It makes for some interesting dinner table discussions!  My advice will be from the Plaintiff's side.

Insurance companies rely on the "3 D's" - delay, deny, discourage.  When you're representing yourself, 9 times out of 10, you are stuck dealing with a representative who simply doesn't have much authority to settle the case.  This agent is there to soften you up and temper your expectations, although they certainly don't mind if you settle with this representative.

The good news:  Fault appears to be clear.
The better news:  The accident happened in Jackson County, Missouri which is a great place to be a Plaintiff, much better than Kansas.

In lower value cases, hiring an attorney may not "add value" as stated by the poster above.  However, it would appear that you're in a situation where you may not be able to "add value" yourself.  Whether it is worth your time and money to hire an attorney depends on a number of factors and simply can't be fully analyzed on the Internet.
