I found an article that said his complaint in the countersuit is that they got onto his device and deleted the pictures. I'm not a lawyer, but I'm thinking if you are suing for someone deleting the pictures off your iphone, then you are probably already admitting guilt.
Link? There's no countersuits in a criminal case and I haven't heard of the women suing him civilly. They may not have issued their pre-suit HAHAHAHAHA letter yet. It looks like he's seeking a diversion for the 2 criminal counts of eavesdropping. Johnson County Case # is 12 CR 1286.
I'll link when I get back to my office, but one of the KC stations had an article say they are suing for $75,000 each and that he sued them for deleting the photos and a judge dismissed it. Countersuit probably wasn't he right term to use.
I see the civil suit now. It's a Federal case, 11 CV 2693. The damages sought are in excess of $75K (75K is a minimum number you have to list). kcatty first tried to get a ruling that pleadings would be filed under seal as he filed that counterclaim you speak of so it's not visible, but plaintiffs' response is, and yeah, they got the counterclaim dismissed. Absent a settlement, it'll be a while.
