how were they cited for pub intox and not dui?
My guess would be because they were on a private drive (thru) rather than on the road.

i don't think it matters

If there's a future DUI, it won't cost them their license. At least I think OK statutes are structured that way.  That's some accomodating offense report and charging right there.  RCPD could learn how to help us instill a MCMW atmosphere.

You've been warned...do not eat at the whataburger at blue mound and north loop 820.  When it comes to whataburger, it's all about location.
Free edge up to defensive starters when opponents held under 10.

Traffic law's that enforceable on private property: reckless driving, careless driving, drunk driving, suspended driving and handicapped parking violations. These are automatic , Some states have statutes that extend all public traffic laws to private property that is generally open to the public. Kansas isn't one of those states. Although I'm unsure of Oklahoma laws, I'm 100% sure that they could /should have given them a D.U.I based off of officer's statement.

Tell that to my son's lawyer, since he got a DUI while parked in the Buger King lot.

DUI's are enforced in most every state, in Kansas they are enforced for sure along with the other traffic infractions I listed above . Kansas does not enforce seat belt, or running stop signs at like Walmart though.

DUI's are enforced in most all states on private property or otherwise.

I went to high school with a guy who passed out in a McDonald's drive thru. He got a DUI, and this was in Kansas.

Most all states including Kansas do enforce DUI's on private property. They can't enforce seat belt tickets  or running  stop signs unless you do so and cause a wreck or nearly strike a pedestrian.
