Legal question
« on: June 28, 2012, 09:21:47 PM »
So last night I evidently left our back porch lights on. About midnight I heard yelling and went out front to see what was going on and just chalked it up to our neighbors to our east being outside drinking and getting a little loud. Well tonight the neighbors to our east inform us that the neighbor to our north ran outside yelling that our light was shining into his house and disturbing his reading. He then jumped the fence and unscrewed our deck lights all the while yelling if their f-ing dog is outside I'm going to break its neck while I'm at it. So here is my question obviously it is trespassing and stupidity because if our dog was outside it would have him on the ground before he could take three steps as our blue heeler is very protective of her yard. But if by chance I would have stepped out back with a 12 gauge as I have done many times when we hear a noise, is it my legal right to blow his f-ing head off?

if he's just yelling and unscrewing light bulbs, no.  but if he makes a move on the dog, then yes.  problem is it'll be your word against his, and he's dead.

That seems more like a solution, but maybe this is jeopardy and we are answering in the form of a question, if that is the case then you nailed it.

just look at the okcat thread, katkid.  people around here have a lot of sympathy for the dead, even when they don't know them or they are assholes.  so the dead guy starts off with all the marbles.

Might be better to just beat him up like in the good old days.

I'm no THE JUDGE though.

Hey, you don't even have a dog!

 :dubious:
If there was a gif of nicname thwarting the attempted-flag-taker and then gesturing him to suck it, followed by motioning for all of Hilton Shelter to boo him louder, it'd be better than that auburn gif.

Put some kind of flesh eating bacteria on the light bulb and then leave it on again overnight.

Pretty sure you are allowed to shoot anyone you want as long as you claim you are part of the neighborhood watch program...

As soon as he touches your lightbulb, that is attempted theft, and that qualifies him for judgement. It sounds like you live in a horrible neighborhood, and if I were you I would find a way to judge them all, one bad person at a time.

Serious answer:  it's going to cost you (or any of us) $50,000 in legal fees to resolve even a rightful shooting.  So really this is a financing question and not a legal question.  I recommend Bank of America.

LOL, no. Just explain to the officer that you had a dirtbag thief on your property in need of judgement, and he will give you a pat on the back, say "Thanks for making my job a whole lot easier", and you won't even have charges pressed against you.
