Don't you think it's pretty hard to ignore people screaming "f.ag" at your sons funeral with signs saying he deserved to do.
There is a difference between should do, and can do. This is abhorrent, but it's impossible to draw a line so I guess we've go to let everything go.

Yeah, it sucks that they are total assholes, but they have the right to be assholes.
Like Rusty said, they only do this for attention, so if we all just stop giving a eff what they do then they'll probably get bored and go away.

It's hard to say you have a right to privacy while at a public cemetery. If the funeral were to take place on private property, then the Phelps' have no right to protest.

Agreed. Nobody but the Phelps likes them doing this, but if they are stopped from doing it then it will open up a lot of new problems.

Fortunately and Unfortunately this is exactly what the 1st ammd is for. If it were up to me, I would be the one to pull the trigger (as long as I wasn't executed for it) but he has just as much right to do this as the KKK motherfoooockers have to fly the swastika and carry signs that read n-word.
Here is another problem, Phelps and his ilk called the police prior to showing up and told them they were going to be there AND voluntarily protested 1000' away. I too would love a local ordinance and I thought that I heard something about something that prevented them from protesting 2-3 hrs prior to a military funeral and 2-3 hrs after the funeral - but I cannot recall where I heard/read that.
I have been milling over this all day and the only thing I can think of is indecency - as in the content of his signage; it's pretty foooocking profane to include cursing (if you call the word f.ag a curse) and the graphic images of the anti-sodomizing. Additionally, I saw a sign with Matthew Sheppard which read underneath it, "Matt is in hell" - I would have to think there was some kind of copyright issue with getting that photo from the Sheppard family. :dunno:

Yeah, it would take a huge government agency/bureaucracy to make protesting funerals illegal :facepalm:
After reading a little bit more about this, I think the case will clearly go to the Phelps monsters. They only protest military funerals, over 1000 feet away from the cemetery, and don't shout stuff at all, just hold their offensive signs. They are even discretionary about which military funerals, only choosing those that the media has been invited to (not surprising here). Apparently the father suing didn't even know they were there until after it happened. Probably not the strongest case to bring to the Supreme Court if your goal was to end this practice. :users:

Actually, it might get kind of interesting if republicans use the result of Roe v. Wade to say that our new health care plan is an invasion of privacy.
