Who has access to the NEC 2011 Edition, specifically the part that would prevent a dumbass from fishing/dragging some romex through a wall (and across a nail) to put a outlet above a fireplace for a flatscreen?

It's been a while since I have been in the NEC, but unless there is something in there about not pulling romex through closed cavities, this is probably a contractor insurance issue rather than a code issue.

Also, I am pretty sure there isn't anything about not pulling romex, fwiw.

How do you make sure you didn't run it against a nail, strip the insulation?

Good question. If you sue the elect, you should also track down the guy that put a nail in the wall that didn't embed in the stud.

For reals, though, adding wire to existing walls will require pulling insulated wire. Even if they used individual stranded/insulated wire that wasn't grouped together in one jacket, like romex, it still would have the chance of catching that nail unless you open the wall up and run conduit(which would be inconsistent with how the rest of your house is wired, most likely).
Romex, for some reason, has a negative connotation associated with it in a lot of ppls minds. It is just wire grouped together. It is a good product for its intended use. Not a lesser product for residential wiring, for the most part.

Romex would be legal, even exposed so long as it is supported properly (think cable staples) and a proper surface mount box was used.

This stuff happens. That is what insurance is for. File a claim W your insurance, they will chase his insurance.

Say my sonos needs to have the power cable stuck behind the wall and drug up about 4 feet and come out behind my tv where the power outlet is? I can just punch a hole back there and fish it through and don't need to worry about stupid electrician stuff correct? Because that's what I did and people keep telling me I'm not supposed to do that.

That wire probably isn't rated for in wall use but not really a big deal
