I got a dui last night, the state trooper made it sound like I would be ok since it is my first offense. What do I need to do, what can I expect? I blew under a .15 so that's why he said it wasn't a big deal. Any advice will be appreciated!

Yeah he said I would be able to get a diversion and would only lose driving privileges for 30 days. I've been googling about it today and yep definitely getting a lawyer.

i know/knew a dude who had 12 dui's and he's still driving legally :eek:

You have like 10 days (maybe 20 now, KSUBrian?) to contest the administrative part. That's what's going to affect your license. Yes, you'll be able to get a diversion for the criminal part of a 1st DUI, but your personal circumstances will determine whether it's worth getting or not.

I got backed into at a parking lot after the snowstorm and it broke out part of my tail light. I ordered a new one and covered the broke one with the temp tape.
Got pulled over for it not being the same level of brightness. New one should be here Monday :party:
I passed field test blew a .12 literally less than 1/2 mile from home.

Yeah he said I did fine on the field test and just blow in the machine and I would be on my way. I had quit drinking 2 hours earlier, felt perfectly fine.

Well obviously you know now but for everyone else, you can refuse to blow unless they have reason to think you have been drinking. At a check point, after passing a field test, etc, they have no right to breathalyze you.

i may be wrong (but just thinking about the logistics, i don't think i am), but i don't think you can be made to take a breathalyzer test. if you refuse, i think they can take you to a hospital for a blood test, but i don't believe they can physically force you to take a breathalyzer test.
presumably, a lawyer will correct me within a few minutes if that isn't accurate.

I don't think there is such a thing as passing the field test. But yeah, don't drink and drive, be a better person. I'm not soap-boxing, I've done it myself.

Buddy got one in a similar situation on shawnee mission parkway and nall a couple of years ago, blew a .10. It was a checkpoint and they had a mobile processing unit on site then he called me to pick him up from the parking lot.
He got a lawyer and was placed on diversion for 1 year, completed the diversion(said it was super easy) and the charge was waived/dismissed assuming he doesnt get one for another 10 years or something, if he does it would count as his second.
But yeah, still lost his license for a month and had to drive with a breathalyzer for a couple months.
TL:DNR- Get a lawyer.

A few years ago, when I was 20, went thru a checkpoint after having 3 or so in an hours time. Felt fine but still illegal. Approached the checkpoint in my buddy's car. Cop asked me if I had anything to drink, I paused nervously, and answered no. That was it.
No is the way to go.

Yeah I said I hadn't been drinking but he said he could smell it... :( there's a lawyer here in Manhattan that specializes in dui`s, I'm going to talk to him tomorrow and see what we can come up with. Thanks for the advice if nothing else I feel a little better.

there is also a lawyer in MHK that specializes in DUIs that sucks horrible ass and got my bud A-pounded
so make sure you don't get that one
or do if you want to get punished like you deserve

Lawyer in my neighborhood said that it is usually pretty easy to beat DUI's in court. He basically said that you have to have been extremely plastered or have a really bad atty to not get out of it.

You know you are going to get raked through the coals because of your last comment, but you are correct. If you are partying with some bros in their neck of the woods (city), then they should expect that you might need a place to crash.

I remember when I realized drinking and driving was bad and I was like... wait... you aren't SUPPOSED to stop in and grab a sixer for the road??? WTF Dad??!?!

When I was a kid, my dad coached our little league team (10-12 years old). He and his assistant coach would drive 6-7 of us in our van to and from games against other small Kansas towns. Often on the way home they would stop and get all of us kids a pop and they would each get a 16 oz Coors for the road. Weird to think about that now. I mean, no other parent thought anything of it and most would do the same thing.
My only similar story to this one was getting stopped one time after fishing. I had one beer over an hour before we left, but a couple of my friends were with me and each had a couple. We were driving across the damn and it was really windy and all of a sudden I see lights. I pulled over at the end of the damn and the officer comes up and asked if we had been drinking because he said "I can smell the intoxicant wafting out of the vehicle". I broke the steve dave rule and said yes, but it had been a few hours earlier. He then asked me to get out of my pick up and as I'm getting out the bud light bottle cap which I had put in my pocket falls out on the pavement and clinks around. He shines his flashlight on it and says "I don't like to see that". By this point I'm scared to death and he asks me to walk back with him to his vehicle. We get in and he starts filling out some papers and then he says "so, did you catch any fish?". I'm thinking what in the world is this guy doing? He then proceeds to tell me that he can tell after our walk that I was fine and it was probably my friends in my pick up that he smelled and then gave me a warning for reckless driving because I was crossing the center line because of the wind on top of the damn. It was a strange experience.

The funny thing is my bros in the pick up were debating on what would happen if one of them just opened the door of the pick up and took off running while I was in the police car.

well, i guess we all make our own rules in the USA. that's the lesson our dads were teaching us. and to this day i refuse to get into my car without an ice cold brew in hand. i don't care where i'm going- work, gym, target, anywhere- i've got at least one ice cold brew with me. it's great. feels great, makes me drive great. booze = fun.

I hear ya 'Clams. You'd be hard pressed to find me with a booze in one hand, without a steering wheel in the other. What would be the point really?

Try to get out of the administrative action on your licence, if you can great, if not you are looking at 30 (might be 45) days of no driving and the rest of a year with an interlock device. Separate from that is the DUI, get that on diversion.
