I need a sounding board here...

I bought a house with a satellite dish on the side a year ago and the HOA is trying to get me to take it down. I told them to get bent because of the FCC Telecommunications Act of 1996.

My questions is this: What kind of argument can they use against that piece of legislation, if any?

Not the neighbor at all! She's cool with the dish and her dog will be taken care of soon enough...

I resigned from the board a week ago and I have a feeling that now they'll try to nail me with the dish policy thing...so i want to make sure I have all of my bases covered.

Oh, well the dog should still be #1 priority.

What if you donate like a bottle of Cristal and Caviar to the next HOA meeting, I bet they would give you like 6 more months before they harass you again.

What are some other good ones?

Here's what I have for TV:

(1) Genie HD DVR
(4) remote Genie clients
Every normal channel (CBS, NBC, FX, AMC, ESPN, etc)
HBO
Starz
Cinemax
Showtime
All the On-Demand channels to watch previous episodes and such.
None of the Sunday ticket or any other additional sports packages.

I pay less than a hundred bucks a month for all of that with DirecTV and the same package will cost me $180 with SlimeWarner.

Doesn't seem worth having a lien put against your house.

There's a reason for homeowner's associations.  It's to keep people like you from making the rest of the neighborhood look bad.  Take down the sattelite dish and remove the garden gnomes too.

I'm wondering how many flamingos are in the front yard as well.  Maybe if you didn't have the rusted out El Camino on blocks they wouldn't give you crap about the dish.  :dunno:

I know a bunch of cases popped up in CA when the CA Solar Act went into effect, attempting to prevent HOA's from regulating placement of solar panels on houses.  Some courts out there said that, notwithstanding the Act, HOA could place "reasonable" regulations on placement of solar panels.  Restriction just can't be arbitrary.

Drive around your neighborhood and find other satellite dishes that the HOA has allowed/not done anything about.  Take pictures and then in the next meeting throw the pics in their faces Matlock/My Cousin Vinny style.

1. Dish was existing when I bought the house. When DirecTV came out to give me new receivers and such, they replaced the dish 1 for 1. Same holes, same mounting bracket, same everything.

3. I can't give that info away or else it'll reveal who I really am and i'm not ready for that here on goEMAW yet...not until I meet you all at Fatty Fest 2014. Lets say you will all know both of them though... My real life friend TheBigTrain can vouch...

Maybe my neighbors dog, that SOAB barks all the freaking time. One antifreeze soaked meatball will take care of his barking... I haven't done it yet because I feel for their kids as they really like the dog. I'm going to start the tactic of a BB gun from my deck first to see if we can train that sucker to not bark. maybe a cause and effect teaching?

Neighbor's dog is not enough.  They will think you are soft if they even put it together at all.  You have to respond to this slight by essentially carpet-bombing the neighborhood.  Leave nobody doubting the consequences of coming after you.

You sound like a cheap rough rider.  If the rules say no dish and you agreed to no dish then you can't have a dish.  Why are you rough ridin' with your neighbors who have a very clear rule that is in the place for the benefit of your property values?  If you got a better deal with TW and took the dish down I bet you'd be the first one to whie if your neighbor put up a dish.

If I were on the board I'd lien your shanty just to prove a point.  Go ahead and try and convince some JOCO judge that HOA regs that you signed are pre-empted by a Federal law.

Let them lien your house.  They have a year to take action before the lien expires.  At that time, they can lien you again, but it is the same process.  If you have not intention of moving in a long time, they will get tired of filing the $100 lien yearly and just stop.  If you do sell your house soon(or refi), I am pretty sure they will have to come up with some reasonable value of the infraction that would have to be sorted out and settled up before the sale could be completed.  What is the value of a quasi hidden dish?  If it is simply the cost to remove it, then that is super easy.  Put the house up for sale but note that the dish is not staying in the sellers disclosure.  Then sell your house and remove the dish.

I am not a lawyer, but it seems like this would work.

Also, just have Direct TV relocate the rough ridin' dish so that it is on your back roof line.  Still get the exposure needed and your neighborhood won't look like the trailer park it does now.

Here's my house and this is the only angle that you can see the dish.

Ben ji: I'm not a terrible person, I just don't like being bullied for no apparent reason. There's no logical explanation that the HOA has that makes me say, "You know what, you're right...i'll take it down"

I'm very easy to get along with and i'm a good neighbor. The dish doesn't degrade property values any more than the yard art that my neighbors have set up. I've checked with all of my neighbors and they're all fine with it being up and agree that the HOA is overstepping their authority. Hell, one of my neighbors is on the board currently and I use to be on the board. I believe it's just a retaliation tactic at this point.

Limestone: There's nothing cheap about me. I am remodeling a house by myself because I love construction and design so i'm trying the best that I can do get everything looking pristine. It just takes time as I do a better job than most contractors would and am pretty meticulous when it comes to finish work. I'm not about to whine about what my neighbors do because it's their house, they can do with it what they want. If you think that a satellite dish that's a quarter the size of a condensing unit is degrading property value more than the condensing unit itself then you're out of your mind. That's not even mentioning hose reels, trash containers, leaf containers, etc. There are larger battles to fight when it comes to accusing people of degrading property values due to satellite dishes.

EDIT: The house on the right is mine, the left one is my neighbors.

Keep justifying why you should be the exception to the exact rules you agreed to.  But its to save money versus cable tv, which is being cheap.  I mean, you have a satellite dish on the very front of your house.  You don't see that outside of Tongie.  Are you putting up an above ground pool this spring?  When are you putting the chainlink fence and dog kennel in your back yard?

That's my neighbors yard that needs care. They're some wealthy doctors/pharmacists from the Czech Republic that hoard money and never pay anyone to do anything...that's a whole different story though.

Oh, the old super rich but don't show it Czechs.  Tell them their dog crap yard is killing your property values.  That looks like a rental in Manhattan where they all park on the yard.

eff, until the edit I thought that was one house.  Move somewhere where you have more than 2 feet between you and your neighbor.  Also, check the HOA rules re: dishes for wherever you move.

The problem is that it can't be visible from the street per the HOA regulations. Every freaking place I can move it to is visible from the street and the one place that it's not is too far away from the house for the coax to run per DirecTV's regulations. I have literally caught the HOA president walking on three sides of my house (all sidewalks of course) looking for the satellite as she's a nazi. Her house looks like trash so i'm not sure why she's bitching at me. She's retired and probably has nothing better to do anyways. She also does a weekly neighborhood drive through to look at all the houses in the neighborhood.

I'm not moving for a long, long time so the wait it out method might actually work. So you're saying that they will have to pay $100 per year to keep the lien active with no yearly penalty to me?

You should get a gun and judge that nazi the next time she comes by. She is casing your house and you have to protect what's yours.

The angle of the picture is deceiving though for distance between houses. My property line is about 5' from their house. So the distance from the dish to the property line between the houses is upwards of 20'. The neighbors don't care at all about the satellite dish though. The fully support me having it and are super nice about everything that do. My only complaint is their dog.

The HOA cannot enforce an illegal agreement. There is absolutely nothing they can do to you. You can let them place a lien on your house, but if you don't like that, you can always just take them to court and have it removed. I certainly wouldn't pay them any fine associated with your having a dish.

Again, not a lawyer, but I would imagine it pretty standard that the earlier mentioned "reasonable cost" would include the cost of the lien(s).   But, yeah.  Liens basically provide a pain in the ass barrier to a person while giving time for another party to try to get some perceived wrong righted.  So, they can lien you but they would then have to sue you to actually force you to pay.  Either that or you have to come to an agreement that would include them releasing the lien.  The latter is what usually happens in home sales type stuff as I understand it. 

To help hide it, you should go get some Army type cammo duct tape and coat it with that so that it is hidden from the street.

That's a pretty good idea.  He could get into Czech sports, just flip open his window and their tv is 5 feet away.

All of his neighbors are insanely rich/famous but hoard their money and don't spend it on their homes.  They are clearly so madly wealthy that they are eccentric.

i'm no yard expert but just between you guys, myself and the fencepost- my two cents is that they just had crabgrass and instead of just spraying it with something that would kill the crabgrass, they sprayed it will something that would just kill the entire ground. see, the thing with crabgrass preventer is that it wears down and the thing that will wear it down the most is heat. the ground closest to cement, curbs, etc is always going to be the hottest and so that's why you are always going to get crabgrass there first, even if you lay down preventer in the spring. that's why it's important to spot spray towards the end of summer. boom. yard lesson 101 from rick daris. the first one's free. hope you all enjoyed.

That's a pretty good idea.  He could get into Czech sports, just flip open his window and their tv is 5 feet away.

How 'bout this?  2 birds, 1 stone.  Demolish the 15-20 feet of the house closet to the Czechs, as part of constructing the new wall/exterior of the demolished side, build something that completely hides the dish or gets it in compliance.  HOA satisfied and you're no longer living in a Czech Big Brother-style reality show.

Agreed.  If you don't like older houses that were built on top of each other with satellite dishes, just move to a nicer neighborhood.

I am now on Shellshock's side.  people can choose their home and it appears a little dish is pretty much the the least of their worries.

You have no idea. These people act like our community in Overland Park is the new Hamptons of the Prairie. It's ridiculous how much time these people waste worrying about others. I actually got stopped the other day while mowing my lawn because I was getting too much grass clipping debris on the sidewalk and they couldn't see the sidewalk well enough to not trip on the joints. I was like, GTFO because I always sweep and clean up the clippings after i'm done mowing. I'm sure it offended them that I said that and don't pay for a professional lawn service but I don't care.

A lot of the older neighborhoods in certain parts of JOCO are getting to be basically all old people.  As the home values in these older areas fell and the HOAs quit enforcing the regulations the higher income folks fled towards better neighborhoods and quality schools.

I have had a discussion with everyone within a 4 house radius about the satellite issue to make sure it wasn't them that had the problem and they are all on my side.

They use the guise of property value to issue their complaints, but really why would an old person care about that? They are either going to die in that house or at the nursing home. It's going to be added space to my woodshop when its all said and done. I'd rather have more woodshop space than a hot tub that i'd only use a time or two per year...

It's crazy actually. The house was sold in the late 90's/early 00's for more than 300k. I drove a pretty hard bargain to get it that low but he knew that it needed someone with renovation experience to tackle the project and it was sitting on the market for a while.

The hardest part about the whole thing was the fact that I had to appeal the county appraisal of 380k. They looked at me crazy when I said that my taxes should reflect fair market value at 208k since that's what it sold for instead of the 380k they had it tax appraised for.

How did that work for you?

This HOA is just a horrible failure. They have one job, to keep land values high, and this house, owned by a former KC celebrity, sells for more than $100,000 below value. People sign contracts to abide by their Nazi rule for the sole purpose of this not happening. This HOA should do the right thing and just disband.

At first I thought the case should have been thrown out but when I read how this poor lady was having difficulty holding her hors d’oeuvre plate at a party, well, justice clearly needs to be served in the form of a $127k judgment.

On another website I saw the jury only deliberated for 25 minutes.  That's outrageous, and in their rush to judgment they are really causing some inconvenience for Auntie Jen  She was probably going to use some of the $127k to hire someone to hold her hors d’oeuvre plates for her.

I dealt with a case of child suing parent for injuries because that's what needed to be done to get mom's insurance company to pay.  Mom wanted to lose that case to get her insurance to pay, because absent insurance, mom was responsible for the bill as child's mom.

The headline and hors d'oevre line sound funny however.
