Not great Spracs, but I find it scary how many dumbasses are raising her up. She could be the new Bernie in 2024.

But you think it's a possibility? I shudder to think . . .
Yes :frown:

But you don't think she could be in play at all in 2020?

Well, you two, I'm a staunch defender of the Constitution of these United States, so I'm not sure I can endorse your opinions.

I realize the facts are irrelevant when it comes to popular politics, but the legal standard for asylum has remained unchanged for some time, and generally unsafe country conditions (in the absence of persecution based on membership in a protected group, such as religion à la the Holocaust) are not--and have not been--a valid basis for asylum. So yes, she's merely playing upon the ignorance of her supporters. That kind of rings a bell . . .

Trigger warning

https://twitter.com/ocasio2018/status/1067078115984375809

A quick check shows there's no such thing as a refugee visa, so once again her message is bungled and completely ignorant.

Yeah, I think it's pretty clear she's not very knowledgeable about how the system functions (I'm sure she was referring to Form I-589, or the seldom-successful Convention Against Torture). But then again, that no longer seems to matter, so . . .

Are they refugees?  Plenty of immigrants coming to the U.S./Mexico border may very well have a basis for a VISA application.  Most, however, are likely seeking asylum which you can request (and have granted) even if detained after crossing the border illegally.  Refugee status is not necessary in any event.

Well, I hear you. But actually, qualifying as a "refugee" under statutory definition is a threshold matter for qualifying for asylum, under the INA.

The INA uses a statutorily-defined term of "refugee" for asylum, but my comment was with reference to the way the term is more commonly used, including through programs the U.S. makes available to applicants separate from the asylum process.

I like you, so I'm not trying to get into a nit-picky back-and-forth, but I'm curious what Visa programs you think these claimants might in good faith be claiming, erm, "protection" under?

I don’t recall saying anything about protection. You can find the common grounds for immigration visa applications on the department of state’s website: https://travel.state.gov/content/travel/en/us-visas/immigrate.html

Relatives of US citizens/lawful permanent residents would probably be the most common basis.

But you don't really think these folks are on this journey just to get to the border, take a ticket, and retreat back to Central America for a few years (decades?) while their relatively unimportant claims are processed, do you?

I still don't know who she is but man the Republicans in this blog sure do.

Who knew saying dumb/ignorant things would really enrage them... You know. .. With who they voted for to be the leader of the Free world and all.... Wonder why the difference in emotions?

The difference is that AOC is vile, morally reprehensible, and cares only about herself. Trump, on the other hand, is gracious, ethical, and compassionate.

completely irregardless of whether or not they are likely to be granted asylum, under international and us law they must be granted a hearing.
