Unfortunately for Trump, the DOJ wasn't going to determine that he was too mentally incapacitated to stand trial. In the same context, the DOJ did not believe that Trump was a feeble figure who would derive nothing more than sympathy and pity from a jury.  Per the DOJ, Don Trump is not some grandfatherly figure in a state of severe mental decline.

I have to admit, relative to the classified documents case, what Trump did was pretty bad.

The FBI only reports on what’s been reported, so if a constituency knows the local police aren’t going to do anything if they bother to even show up at all, they’re not going to report crime.

Nearly 20% of law enforcement agencies don’t even bother to participate in the FBI crime reporting process.
