There is grounds to invalidate this agreement.  In Kansas an agent needs to have actual or apparent (ostensible) authority to bind his principal.  I would argue Prince and his lawyer knew full well there is no way in HELL that KSU would give Krause the kind of authority to make this type of payment.  I suspect there is a by-law or operating procedure that states any contract over X must be approved through various channels.  Some dean cannot go buy a jet to take a field trip and if you sell him a jet you had better be ready to eat what he cannot pay personally.  

In reality though, the lawsuit will cost KSU in legal fees and there will be a settlement reached.  I would bet Prince still gets at least $1.5mil of this amount.

The best way to really shake the trees is to have the AG's office ask BK and RP to come in to "chat"

He is at best a moron and at worst a criminal.

Great question and I do not know the answer BUT, when looking to whether an agent had apparent authority to bind their principal, you look to the words and acts of the principal to the third party.  If BK was the CEO and unquestioned exec of the IAC (as opposed to Weefer being the exec of KSU), then we could be in trouble.

I would like some clarification on why there would be a payout between 2015 and 2020, and why/who to the LLC? It makes no sense. None at all, even if Prince was awesome-o.
