Was he charged with statutory rape or was it actual rape? I thought it was like he was eighteen and the girl was fifteen...
-
statutory
-
That's what I thought.. If it was full blown rape I would be extremely against having him on the team but since it isn't full blow rape I am less weary about it..

It wouldn't make any difference to me.

This is stupid. Probably 25% of seniors in high school could be charged statutory rape...Hell I think I could of been...I ended up marrying the girl. It isn't a big deal. Move on.

Don't know if you are criticizing me or not. I said statutory wasn't really a huge deal to me. That I was fine with having him on the team if it was a situation like that because a situation like that is bullcrap.

Evans didn’t even nail her. At least that is what both the girl and the five other guys that did nail her testified to in court. He was just there at the wrong place, at the wrong time. And that is why he refused to accept a plea deal for a year and a half! If he could have afforded the lawyers fees he would have probably refused the plea deal and would still be contesting the charges...
-
The article that I read says that he only touched her without her consent (because she was drunk) and it says the other guy touched her in an indecent manner without her consent. So what does that mean Tyree even did?
I got the idea that he would have kept fighting it but stopped because we declared that we wouldn't recruit him anymore. Right after Weiser came out and said that he plead down...

It was 'inappropriate touching' of a girl 'too intoxicated to legally consent' who was under the virginia legal age of consent. And he didn't even end up with the statutory charges.
Basically the same thing as when a high school senior nails a high school sophomore in KS(age variable.) Not that big of a deal it would seem, but if the parents of the sophomore girl find out they could press charges and suddenly you're listed as a rapist for the rest of your life.
Kind of a bum law, IMO. It's designed to keep pedophiles from having sex with 15 year old girls (in Kansas, 16 and even 17 in some other states) but usually ends up screwing some poor high school guy who was just having sex with his fully consenting 2.5 year younger girlfriend and the parents finding out. I'm all for stopping pedophiles, but this law does probably as much harm as good. There should be some sort of clause that protects those who are 18 and 19.

Read the article and Waks posts. The other guy "touched her in an indecent manner without her consent" and Tyree "touched the victim without her consent".
That's rough to get two years probation for that.
-
Real sports did a bit on a star football player in the south that had consentual sex with a 16 year old that landed him in jail for quite a while, at least 5 years.

Either way, this is basically what happened:
Tyree, who is 18 at the time, is at a party
There are drinks at this party. And at least one drunk girl.
Said drunk girl is 15.
Tyree does -something- of the sexual nature with said drunk 15 year old, but doesn't physically force her to do anything.(If he had, he'd be in jail right now.) For all we know, she was consenting, but because she was drunk the courts rule her incapable of legally consenting.
Girls parents find out.
Big crap storm ensues.

Did you ever end up finding out if you were having a kid?

I don't think he did anything sexually. He just touched her...hence no "indecent touching" mentioned with Tyree. If I understand it correctly, he was just in the room while sexual stuff was going on.

Did you ever end up finding out if you were having a kid?
Yes.
6 weeks into it. :D
He/she will actually be born in Manhattan. We're moving back to finish school up in August.
Being married has some SERIOUS financial aid benefits.

I know, because you are no longer considered under your parents' income. Hopefully you get to live in the new Jardine Apartments.

I don't think they would have crucified Tyree like they did if he was just in the room while stuff was going on. I'm sure something happened, but I don't think it was something 'wrong' or something that doesn't happen every weekend at high school parties.
-
Are you getting married just because of the kid, or are you already married?
If you're doing it because of the kid, I don't think that's very smart. JMHO.

Just try to use a little logic here. Why would the DA say that one guy touched her indecently and the other guy just touched her?

The article that I posted just says Tyree touched her without her consent. It says the other kid touched her in an indecent manner without her consent. That is what Rusty is getting at...

He's getting married for the financial aid.
-
Living in jardine is the plan. They're cheap as &@#%, even the new 1 bedroom apartments.
However the 2 bedroom apartments are a little more pricey. Like $900 or so, compared to <450 for the rest.
And yeah Rusty, I know. I'm not getting married because of the kid. We had been planning to get married this summer before we ever found out she was pregnant. The fact that she's pregnant just solidifies our plan. The financial aid benefits are just gravy.
I hope you guys are right about Tyree. Either way, I still think he was butt&@#%ed by the legal system and didn't do anything that doesn't happen at every high school party around the nation.

The rest of the story is that one of the kids that did nail her took pictures of his buddies having their way (hence the blurb out child pornography). And then the kid posted the pictures on the Internet. And then the 15 year old’s dad found out, and he went pretty much app$hit crazy. He happened to be well endowed with dollars (certainly enough to get the attention of the school and local prosecutor) and he wanted revenge that his lily white 15 year old daughter just got screwed by a bunch of black kids. And the end result was that Evans was in the wrong place at the wrong time.

there are 2 ways to view the evans legal situation.
1. he got screwed.
2. he is lucky he didn´t live in georgia.

OUCH.
Man, the south is &@#%ing crazy.
I forget the state, but there's a state where it's illegal NOT to go out @ 11:00 PM every night and shoot a shotgun. Also one where the punishment for spitting in front of a lady is a minimum 1 month in prison. They're too stupid to change some archaic laws like that.

"screwed" is a synonym for "had sex with"
-
It was a plea deal.
I think you go longer on probation if you serve no jail time.

oh, a pun. those are great.

another way to view it is that he didn't father a bastard.
