KSUFANS will no longer be selling the KSUFANS created Hugginista T-Shirts. The University contacted the vendor for the shirts, and told him to discontinue selling of the shirts. The reasons given were that Huggins name and likeness are protected property and that the phrase "Hugginista!" does not project a positive image of the university. Since G-Degree is a licensed vendor from K-State, they were contacted directly about their use.
If we are to use Huggin's likeness, we must first run it by the University to makes sure it promotes a positive image for the University. I do not want the vendor to lose his license. He spent a lot of time and money to get that privilege. Therefore, we've decided to discontinue selling the shirts.
Obviously, if we can come up with a shirt design that is "positive" and acceptable by the University, then those would not be a problem. My intention was to sell the shirts to help in raising money for support of the website, but I can't obviously do that and harm someone else's interest. Therefore, if we can come up with something that he might be able to get approval for, and use Huggin's likeness, then I think it works out.
So the shirts, are now collector's items. If you managed to get one, you own a unique piece of memorabilia.

My guess is that Huggins owns his likeness, and I wouldn't be surprised if he didn't like his image used in that manner. Then again, no one really asked him. In all honesty, we learned a lesson today about the shirts. That's not to say we couldn't make something on our own. KSUFANS is not affiliated with the University, so we have some leeway. I can't sell anything that has protected K-State logo's, but we could come up with our own and I have KSUFANS registered as a trademark (God, how much money I spent registering trademarks..) so I can use that if I wanted to. I don't need the University coming down on me.
On a side note, they know about this site. We haven't done anything so egregious (yet) that they feel compelled to contact me directly, and I have no problem discussing this site with them if they so choose. I don't need their endorsement, and I'm not looking for it, but I certainly feel we can have a "positive" impact for the University. We have an expanding base of fans that doesn't necessarily follow the "company line" and it's growing every day. That's not a bad thing, and in fact, it's a great thing. I understand the image thing that KSU wants to project, but you cannot create a passionate fan of the University based on some mold designed by a few people at the top. Passionate, caring and loyal fans come in all forms and each has their own way of contributing. I hope they recognize that such diversity, as Dr. Wefald is always promoting, is a strength, and that we shouldn't have to fit their mold in order to be great fans.

Now if you want to sell shirts like hotcakes and totally avoid any issues of this sort just have some purple shirts made up that say "&@#% ku!" on both sides. You'd probably be able to retire in a month.

If it was not as "difficult" as you claim, then certainly, it wouldn't have been difficult for you to relay a "Hey guys, you think maybe you should.." and then we could have not gone through all the trouble of putting up funds to start this project. I don't know what your qualifications are, nor did I believe I had to consult with you first either as matter of practice, or that I would have known what to ask.
I had no idea what KSU had or didn't have as far as intellectual rights, nor did I realize it would cause a problem for the vendor. That's really the point. If as you state, this could be used as an example in a class of what not to do regarding intellectual property, then I would imagine that since this, apparently, is a textbook example, then you could have said something.
But you didn't. Instead you added to the project input, even offering opinions on your view of the likeness. Now you're telling me you'd buy a shirt, even though the same result would have happened. Now, the vendor and I are both out funds, and the time spent by the guys making the design, are also out. I'm sure that you'd say "Well I didn't like the design, so it doesn't bother me" but it does bother me. I suppose I learned my lesson the hard way, and shame on me for even trying. The problem I have is the absurdity in knowing that someone may have been able to provide that knowledge to help us avoid the pitfall of having to spend money and time, and yet chose not to, even going as far as helping to exacerbate it. While the consequences aren't that bad (we haven't been disassociated, and the vendor still gets to keep his license) we're getting to watch you laugh at a distance and try to make light of something I and others put time and effort into. Sorry if I take it personally, but considering that I bear all the costs for this site for you and the others that post, I guess I shouldn't. Yep, I'm a fool. You got your laugh.

Funny stuff. The funny thing is the whole Hugginista concept, AK, Triunfo, etc. was a sarcastic reaction to Xavier fans. Its funny how this kind of stuff takes its course. Now I wish I had ordered a shirt sooner.

now this is comedy. youre right. its not difficult. but try juggling many things at once while doing these. i appreciate the fact that i was approached to do them, and did the best i could to envision the look MJ was going for. i was making the image for him. and as long as he was happy.... i was happy.
so yes, you can step up next time. try not to do washed out generic photoshop filters that anyone can learn through a blog.

You're waaaaay off in your interpretation of that comment. And you're a graphic artist, no? You should therefore be at least passingly familiar with kindergarten level intellectual property law which would have been more than enough to at least raise a few red flags for this project. For the basics just Google "right of publicity" or check out this mini-introduction to the topic. (http://www.law.cornell.edu/wex/index.php/Publicity) That's not the only applicable body of law but it is the most obvious.

In addition, I should've chimed in awhile ago about Huggins; because Huggins has his own company, just like Bill Snyder owns his own company, and lots of coaches and pro players do . . .they're set up to handle their property, their speaking engagements, their camps etc. etc. etc.

SOB, didn't get mine and now it's all over. Sorry MJ, you'd think that having someone who visits this board daily and knew the situation would have stepped up and helped save you all the trouble. Hope it did not set you back considerably. Either way we should get a new "acceptable" design going (even though I have not skills to help), even if only to help you who've invested time and money to recoup.
