Seems to me that receiving any profit from his likeness would probably violate some NCAA regulation. Since he's in the College's uniform on the game, I don't believe he could be paid.

He can't. Thats why they never use the player's names in the games. And I would be willing to bet that student athletes sign some sort of waiver allowing the university to use their likeness for promotional purposes. Really kinda doubt the NCAA or EA Sports would leave themselves open to any lawsuits like this. I assume this is the first lawsuit filed on this matter, probably a very good reason for that. Any Joe Blow off the street can hire some shady attorney to file a suit over just about anything. Doesn't mean that suit has a leg to stand on though.

I think it would be great if the NCAA was able to pay the athletes a small amount in order for the NCAA to use them to market stuff. Names on jerseys and in EA games, etc.
