So last weekend was my birthday.  I went to the plaza with a bunch of friends and then my sister, who is of legal age, drove me home because I was obviously not sober.  Unfortunately, neither was she.  She got pulled over, in Overland Park, and blew a .21 and was arrested.

So, she talks to her attorney today and he says that because it was above a .15 that she will probably not be allowed to drive ANYWHERE for a full year and then have a restricted license where she could only drive to work and home for the second year.  That, and she also has to have the breathalizer thingy to be able to turn her car on.

Is she just totally and completely f'ed?  Any chance that it gets reduced?  I mean, I understand she made a mistake, and a very serious one.......but she has never even gotten a ticket before this.  If they enforce that, she will probably lose her job because it requires her to drive around the city to meet with clients....which she wouldn't be able to do for the next year.

Money is not an issue....she would be willing to fork over 10k for the right attorney. 

Any suggestions and or referrals for attorneys would be greatly appreciated.

just hire a really good attorney. there are so many things in DUIs that can get your punishment either lessened or dropped. from my experiences and what i've heard it is pretty tough to get out of the ticket part, but easier on the suspension part.  they are two different courts and dates (were 4 yrs ago anyways)

there are lawyers that specialize in moving violations and some just mainly on DUIs. you can get a work and school restriction and no full suspensions.... i don't kn

yeah, the more you spend the better off you usually are.

.21 is pretty high though.

Everywhere I have checked on the internet it says max one year suspension for first time offenders.  WTF??

pretty much sums it up.  kansas and arizona have some of the toughest dui laws in the country now.
if this is her first one and her job requires her to drive, my guess is something will be worked out, at a price.

it sucks but it's hard for me to feel sorry for someone that went Jaron Rush around the city my family and i live in...

Sheesh, laws have changed.  I blew .282 on my DUI in 1990, and I got a diversion and three months suspended license and that was that.

diversion - Almost a given if first offense.  A good lawyer will likely find something that can get her completely off the charges (like money for the judge).

She crossed over the middle line.

I just don't get how she gets in twice as much trouble because she was drunker than someone that blows a .15.  That's like 2 kids saying a swear word in school and one of them gets a spanking because he said ass and the other one gets expelled for saying f$#@.  They are both swear words.  And they are both driving under the influence.

Not allowing someone to drive anywhere for an entire year is basically f'ing them over, knowing that if they have any job that requires a small amount of travel, they are screwed.  She's not asking for people to feel sorry for her that she is in trouble.  She knows she f'ed up.  But holy tits.

DUI has gotten REALLY serious in Ks. I have a friend who got off recently because the copper didn't show. His attorney is the "dean" of some anti DUI lawyer association and gives seminars and is here in KC. But other than that .21 is extremely high! DUI is serious and they get crazier and more expensive every year, which is why we know take cabs. It's so worth the $40. She may lose her job and that would suck but fortunately no one was hurt, but she will likely lose her license, I understand in KS that is mandatory now.

Diversion won't keep your license from being suspended, and it probably won't keep an alcohol offense off her record.

Her only hope is that the cop screwed up procedurally.   :flush:

I've always been told you should refuse to take the test if you know you are drunk [and going to get arrested anyways]. 

I don't think they will let you get off easy taking this route, but at  least they couldn't prove you were past the limit at the time of getting pulled over.   :popcorn:

<I don't condone anything here as I am not a lawyer, nor have I ever gotten pulled over when over the limit.  Just what I heard from several different people... :ksu:

I heard if you get a DUI with your mother and grandma in the car they will not let you walk down the street to the Pike house with a beer in your hand at 5 am just because you want to crap on their roof.

ASIcat should have gotten out of this situation cause the officer didn't handle the actual "DUI papers" to me, instead to the juvie officer, it was off camera and had no way to prove it (but i swear this happened, officer denied, juvie officer made herself unavialable, even at 17 i could tel the officer was full of crap when the judge asked him if he handed me the papers, he was as scared as a horse in a glue factory) also at the time anyways, should have gotten off, cause my lawyer requested the tape from the "jail house" (i guess) and you are suppose to get 2 BAC test at the house twenty mins (IIRC) apart. well the taped prove my two test were about 15 mins apart. my lawyer said he had gotten plenty of people off this way... just my luck though, the stupid dyke ass judge said she had no time to review the evidence and there i spent 365 days without a DL, july 10th til july 13th w/out a DL (just my luck the 10th, when i could have gotten my DL back was a saturday and the DMV aint open on mondays)...

oh and i got the DUI on Feb 27 and toke me til June 1st i think to have the DL court decide i lose my DL on July  10th for a year.
