Everyone is fine...the lady in the QX4 was creeping out from the stop sign, didn't see me, and I hit her.

Cop said "She was practically stopped and you were speeding."

No tickets for me (or her), but that's what the guy said he was putting in the report.  Said it's up to the insurance companies to sort everything out.

She even said "I'm so sorry" right when it happened.  :curse:

There was an off-duty cop standing right there when it happened...he told the traffic cop dude I was speeding..  Her admission of guilt was not in the police report.

Dude- I drove right by that this morning on my way to work, probably 8:20-8:25am.  The KCMO PD wasn't there yet.
I park in the garage next to Capital and was driving down Jefferson, the cop in front of the Security Cop in front of the Infinity in the pic was directing traffic.  He had me hold on a second then I drove behind the Infinity on the 48th side when some jackass ran the stop sign on 48th and turned right in front of me onto Jefferson.  I honked my horn and flipped him off.  Basically your wreck almost got a lot bigger had he hit me.

Sorry dude, that sux.  I think I heard the wreck, it's right outside my place.  :-[  The tree next to the security guard is in front of my place.

Yeah, but I also have a $500 deductible.  <-I do not want to pay $500.

It's close to 100k miles, so it might get totaled.  I don't know how these things work.

Doubt they will.  You could try getting the $500 in small claims court.

Then again i'm not a lawyer or anything.  I just know insurance companies are a PITA to work with and don't like paying a dime for anything they don't have to.  Have you called your insurance company yet?  I doubt they total the car, really.

You can try to get them to pay for it but they probably won't pay for all of it.  Missouri has pure comparative negligence laws.  That means that if you can show she was even 1% at fault they will pay 1% of your damages and so on up to 100%.  You may be able to get them to accept some liability % but they will almost certainly not pay for your entire damage unless you can get some witnesses or something to say that she was at fault.

He is going to sue you also.  Get a written or recorded statement from him that the accident was not your fault for he lawyers up.  Make sure that, if the statement is recorded, he makes it clear that he is aware that he is being recorded.

"Holy crap an accident. I'm glad I caught the very last glimpse of that so I could tell how the whole scenario played out. Bad deal when you have a cop making a statement against you.  Her insurance company will have all the evidence they need to turn down any claim.  F'in cops.   

Better get all you can documented and signed asap Rusty.  People do weird crap during things like this.  Even if she is willing to accept blame today, she may change that (and being female, well ....) tomorrow.  Same with your friend, even if not likely, get it on papers.  F'in cops.

Some cops are amazingly good at estimating speed without a radar gun, FYI.  I saw a demonstration by one once in Merriam who was predicting speeds before he shot the gun, with me standing right by him, and he was within 1 mph every time, everywhere from 25 to 45.

They'll always opt to pay less or deny if they get any type of chance because they know many won't pursue the issue further.  You're not, however, out of options with them just because they initially denied the claim.

That's what I was thinking.  Just like Super Dave doing all those crazy stunts, and he had his oriental side-kick right there feeding him all the data and taking pictures.  Doesn't mean you can't help him out now that he's learned the lesson though.
