Who's fault was it? What happened?
Edit: A QX4?

Everyone is fine...the lady in the QX4 was creeping out from the stop sign, didn't see me, and I hit her.
Cop said "She was practically stopped and you were speeding."
:curse: :curse: :curse:
-
And she had a ku license plate thingy.
-
She pulled out, so you hit her and it's your fault? Are you kidding???

No tickets for me (or her), but that's what the guy said he was putting in the report. Said it's up to the insurance companies to sort everything out.
She even said "I'm so sorry" right when it happened. :curse:
-
She admitted guilt. Cop could not tell if you were speeding unless he was clocking you while it happened (unlikely)
-
Go to the ER :blindfold:

There was an off-duty cop standing right there when it happened...he told the traffic cop dude I was speeding.. Her admission of guilt was not in the police report.

That's bullcrap

Do you have collision/comprehensive insurance?
-
Is Slimz going to represent you?
-
Dude- I drove right by that this morning on my way to work, probably 8:20-8:25am. The KCMO PD wasn't there yet.
I park in the garage next to Capital and was driving down Jefferson, the cop in front of the Security Cop in front of the Infinity in the pic was directing traffic. He had me hold on a second then I drove behind the Infinity on the 48th side when some jackass ran the stop sign on 48th and turned right in front of me onto Jefferson. I honked my horn and flipped him off. Basically your wreck almost got a lot bigger had he hit me.
Sorry dude, that sux. I think I heard the wreck, it's right outside my place. :-[ The tree next to the security guard is in front of my place.
-
Do you have collision/comprehensive insurance?
Yeah, but I also have a $500 deductible. <-I do not want to pay $500.
It's close to 100k miles, so it might get totaled. I don't know how these things work.

Should have said "Hi!"! Almost three or four wrecks happened when I was waiting for everything to get sorted out.

'Clams! You can testify to the at-faultedness of that lady! You cany keep Rusty from getting his britches sued off! You can help Rus stay in the nice vaccum cleaner lifestyle he currently enjoys! You can make it possible for Rusty to still have some nice stuff for the crackheads to steal! You have the power!
-
Sry Rus. Think you are out $500 unless they total it. Then you get to get a new car! :excited:

Even if her insurance takes the claim?

Isn't it great how good the newly paved roads of the beautiful and historic Country Club plaza look!

Doubt they will. You could try getting the $500 in small claims court.
Then again i'm not a lawyer or anything. I just know insurance companies are a PITA to work with and don't like paying a dime for anything they don't have to. Have you called your insurance company yet? I doubt they total the car, really.

You can try to get them to pay for it but they probably won't pay for all of it. Missouri has pure comparative negligence laws. That means that if you can show she was even 1% at fault they will pay 1% of your damages and so on up to 100%. You may be able to get them to accept some liability % but they will almost certainly not pay for your entire damage unless you can get some witnesses or something to say that she was at fault.

I've called mine, and they told me to call hers. And I did.

I had a passenger, but he's Chinese.
She has a cop.
:crybaby:

He is going to sue you also. Get a written or recorded statement from him that the accident was not your fault for he lawyers up. Make sure that, if the statement is recorded, he makes it clear that he is aware that he is being recorded.

It's pretty funny to hear a Chinese guy say "Bullsh*t" over and over and over. He was really mad at the cop.
-

Man I really don't like cops. I'm going to go out on a limb and say this was the civilian cop's mindset.
"Holy crap an accident. I'm glad I caught the very last glimpse of that so I could tell how the whole scenario played out. Good thing I was here, it would take someone with loads of experience in physics and mindless traffic cop duty to be able to tell what really went on here. Oh look, a vagina in that car, maybe she will look at me as a slightly attractive person if I take her side. Excuse me officer, he was speeding!!!"

Bad deal when you have a cop making a statement against you. Her insurance company will have all the evidence they need to turn down any claim. F'in cops.
Better get all you can documented and signed asap Rusty. People do weird crap during things like this. Even if she is willing to accept blame today, she may change that (and being female, well ....) tomorrow. Same with your friend, even if not likely, get it on papers. F'in cops.

Is it still for sale?

Still going to the CBE? :hope:

If I was allowed to, I'd help you out (and do it pro-bono). Anything for a chance to stick it to a ku fan after my last couple of weeks at work.
Some cops are amazingly good at estimating speed without a radar gun, FYI. I saw a demonstration by one once in Merriam who was predicting speeds before he shot the gun, with me standing right by him, and he was within 1 mph every time, everywhere from 25 to 45.
-
See?
If you weren't so damned cheap and got a REAL SUV you could have taken out her front end and never had a problem.
LOL at you "import" drivers..

If I was allowed to...

Regardless of whatever magical abilities a cop may have it won't stand up in court. I'm only a first year and I know that...come on
-
Her insurance denied my claim. Police report said I was speeding. Negligence on my part. sh*t.

You can take her to small claims court for your portion of the deductible (500?). I guess? Try out Judge Judy, that would be fun.

They'll always opt to pay less or deny if they get any type of chance because they know many won't pursue the issue further. You're not, however, out of options with them just because they initially denied the claim.
-
I just filed a claim w/ my company.
-
That's much less of a PIA.

BTW, I agree that it was probably Rusty's fault. Cocky, mid-twenties dude with a manual transmission racin' around the streets of KC, not really paying much attention, and on the way to work - that's basically a ticking time bomb for wrecks. What does everyone else think?

That's what I was thinking. Just like Super Dave doing all those crazy stunts, and he had his oriental side-kick right there feeding him all the data and taking pictures. Doesn't mean you can't help him out now that he's learned the lesson though.
