Well, there is still the sentencing phase, hence the sentencing memorandum. And whether or not subject matter jurisdiction exists cannot ever be waived. In fact, the court has the obligation to raise the issue sua sponte. Even with a guilty plea, you are still allowed to argue that the court lacked subject matter jurisdiction. And a case can be dismissed at any phase under Rule 12(b)(2).

I'm sure it was a hail mary, and clearly it got swatted down. Still, some lawyers feel they're not doing their job if they don't attempt such maneuvers. Plus, without knowing what was in the memorandum, it's possible there was some issue preservation stuff afoot. Or perhaps, who knows? Maybe this was a smoke signal for the higher courts. Nothing surprises me anymore with this regime.
